(a) A Wind Energy System shall be considered a "Conditionally Permitted Use" in all Zone Districts in the City of Salem. A Large Wind Energy System in a C-2 General Commercial and M-2 Heavy Industrial Zone District, shall consist of not more than two (2) wind turbines, shall be located on a parcel containing a minimum of four (4) acres under single ownership. A Small Wind Energy System may be located in any Zone District. Only one (1) Small Wind Energy System turbine shall be permitted at any single residential site or parcel in a Residential Zone District. The Board of Zoning Appeals shall determine the number of Small Wind Energy turbines at any single location in a Commercial or Industrial Zone District.
(b) No Wind Energy System shall be constructed or located within the City of Salem unless a "Conditionally Permitted Use" has been approved by the Board of Zoning Appeals and a permit has been issued to the applicant by the Zoning Officer. Application for a Wind Energy System shall be made to the City of Salem Zoning Office. The Board of Zoning Appeals shall approve the total height for all Wind Energy Systems
(c) The conditionally permitted use permit application for a Wind Energy System shall be made in compliance with this chapter and Section 1139.04
