§ 111.01 LICENSE REQUIRED; EXCEPTIONS.
   (A)   It shall be unlawful for any person to sell or dispose of, offer for sale at public auction or cause to permit to be sold, disposed of or offered for sale at public auction any goods, merchandise, or other wares without a license issued by the Clerk-Treasurer
   (B)   The provisions of this division (A) above shall not apply to local charitable or civic organizations, nor shall it apply to the sale of any property under legal process or under the terms of a mortgage by the mortgagee or his assigns, nor to sales by executors, administrators, guardians, trustees or receivers acting under a court order, or to sales by or on behalf of pawnbrokers of unredeemed pledges; or to warehousemen or garage keepers to enforce their liens for labor and materials on chattels so exposed for sale; or to any other lien to goods sold as provided by law to enforce any lien, or to sales made by public officers in the line of duty, or to sales of household goods for the actual owner therein, or to sales of real estate.

§ 111.02 APPLICATION; NOTIFICATION OF POLICE CHIEF.
   (A)   Any person desiring an auctioneer's license shall file an application with the Clerk-Treasurer containing the applicant's name, the location of the proposed auction, the type of merchandise to be sold, and whether it is a permanent or temporary business.
   (B)   The Clerk-Treasurer shall notify the Chief of Police of every such application.

§ 111.03 LICENSE FEE; TERM OF TEMPORARY LICENSE.
   (A)   Every person desiring an auctioneer's license shall pay the appropriate fee listed below to the Clerk-Treasurer:
      (1)   Annual fee for livestock auction   $25
      (2)   Temporary fee for sale of goods, wares and merchandise, per day   $5
   (B)   A temporary license may be issued for a period not exceeding ten days.
