§ 151.45 MINIMUM STANDARDS FOR BASIC EQUIPMENT AND FACILITIES.
   No person shall own, maintain, rent or occupy any dwelling unit for the purpose of living, sleeping, cooking or eating therein which does not comply with the requirements of this section.
   (A)   Food preparation area. Every dwelling unit shall have a room or portion of a room in which food may be prepared and/or cooked, which shall have an adequate circulation area, and which shall be equipped with the following:
      (1)   A kitchen sink in good working condition and properly connected to a water supply system which meets appropriate village codes and which provides at all times an adequate amount of heated and unheated running water under pressure, and which is connected to a sewer system;
      (2)   Cabinets and/or shelves for the storage of eating, drinking and cooking equipment and utensils, and for food that does not under ordinary summer conditions require refrigeration for safe keeping; and a counter or table for food preparation. Said cabinets and/or shelves and counter or table shall be of sound construction and furnished with surfaces that are easily cleanable and that will not import any toxic or harmful effect to food;
      (3)   A stove, or similar device, for cooking food, and a refrigerator, or similar device, for the safe storage of food at temperatures less than 45°F, but more than 32°F under ordinary maximum summer conditions, which are properly installed with all necessary connections for safe, sanitary, and efficient operation; provided that such stove, refrigerator, and/or similar devices need not be installed when a dwelling unit is not occupied and when the occupant is expected to provide same on occupancy, and also provided that sufficient space and adequate connections for the safe and efficient installation and operation of said stove, refrigerator and/or similar devices are provided;
      (4)   Every kitchen shall contain not less than three duplex outlets.
   (B)   Bathroom. Within every dwelling unit there shall be a non-habitable room which affords privacy to a person within said room and which is equipped with a flush water closet in good working condition. Said flush water closet shall be equipped with easily cleanable surfaces, be properly connected to a water system that at all times provides an adequate amount of running water under pressure to cause the water closet to be operated properly, and shall be properly connected to a sewer system.
      (1)   Such room shall contain a window which may be opened for outside air or mechanical or gravity ventilation in proper operating condition.
      (2)   The floors and fixtures in such rooms shall be grouted, caulked or sealed to prevent the escape of moisture into adjoining sections of apartment buildings.
      (3)   Every bathroom shall contain not less than one outlet within 30 inches of the wash-basin. Every bathroom shall contain one switched electric light fixture.
   (C)   Lavatory sink. Within every dwelling unit there shall be a lavatory sink. Said lavatory sink may be in the same room as the flush water closet, or, if located in another room, the lavatory sink shall be located in close proximity to the door leading directly into the room in which said water closet is located. The lavatory sink shall be in good working condition and properly connected to a water supply system which meets appropriate village codes and which provides at all times an adequate amount of heated and unheated running water under pressure, and which is properly connected to a sewer system. Water inlets for lavatory sinks shall be located above the overflow rim of these facilities.
   (D)   Bathtub or shower. Within every dwelling unit there shall be a room which affords privacy to a person within said room and which is equipped with a bathtub or shower in good working condition. Said bathtub or shower may be in the same room as the flush water closet or in another room and shall be properly connected to a water supply system which meets appropriate village codes and which provides at all times an adequate amount of heated water at a temperature of 120°F and unheated water under pressure, and which is connected to a sewer system. Water inlets for bathtubs shall be located above the overflow rim of these facilities.
   (E)   Bedrooms. Bedrooms shall meet the minimum square footage requirements of this subchapter. No bedroom shall contain less than two separate duplex outlets. No bedroom shall contain less than one switched ceiling or wall type electric light fixture, or one switched duplex outlet. Required switches shall be conveniently located at the entry to the bedroom.

§ 151.46 MINIMUM STANDARDS FOR LIGHT AND VENTILATION.
   No person shall occupy as owner or occupant or let to another for occupancy any dwelling or dwelling unit, for the purpose of living therein, which does not comply with the requirements of this section.
   (A)   Window or skylight; daylight. Every habitable room shall have at least one window or skylight facing directly outdoors provided that if connected to a room or area used seasonally (e.g., porch) then adequate daylight must be possible through this inter-connection. The minimum total window or skylight area, measured between stops, for every habitable room shall be at least 10% of the floor area of such room but if light-obstruction structures are located less than three feet from the window and extend to a level above that of the ceiling of the room, such window shall not be deemed to face directly to the outdoors and shall not be included as contributing to the required minimum total window area.
   (B)   Window or skylight; ventilation. Every habitable room shall have at least one window or skylight facing directly outdoors which can be opened easily, or such other device as will ventilate the room adequately, provided that if connected to a room or area used seasonally then adequate ventilation must be possible through this inter-connection. The total of openable window or skylight area in every habitable room shall be equal to at least 45% of the minimum window area size or minimum skylight window size, as required in division (A) above, except where there is supplied some other device affording adequate ventilation and approved by the Police and Public Safety/Health and Property Chairperson.
   (C)   Climate control devices. When facilities for interior control (heating, cooling and/or humidity) are integral functions of structures containing dwelling units or rooming units, such facilities shall be maintained and operated in a continuous manner and in accordance with the designed capacity of the installed equipment. During instances when the integral equipment is inoperative because of power or mechanical failure, alternative provisions for fresh air ventilation of each dwelling or rooming unit shall be provided.
   (D)   Ventilation in bathroom and food preparation room. Every bathroom and water closet compartment, and non-habitable room used for food preparation, shall comply with the light and ventilation requirements for habitable rooms contained in divisions (A) and (B), except that no window or skylight shall be required in such rooms if they are equipped with a ventilation system in working condition which is approved by the Police and Public Safety/Health and Property Chairperson.

§ 151.47 GENERAL REQUIREMENTS RELATING TO SAFE/SANITARY MAINTENANCE OF PARTS OF DWELLINGS (EXTERIOR AND INTERIOR REQUIREMENTS).
   No person shall occupy as owner or occupant or let to another for occupancy any dwelling, or dwelling unit for the purposes of living therein, which is not safe, clean and fit for human occupancy, and which does not comply with the particular requirements of this section.
   (A)   Exterior requirements.
      (1)   Safety. Every foundation, roof exterior wall, outside stair, every unenclosed porch, and every appurtenance thereto, shall be safe to use and capable of supporting the loads that normal use may cause to be placed thereon; and shall be kept in sound condition and good repair. Every outside stair or step shall have uniform risers and uniform treads.
      (2)   Foundations, walls, roofs and exterior surfaces. Every foundation, roof and exterior wall, door, skylight and window shall be reasonably weather-tight, and damp free, and shall be kept in sound condition and good repair. Floors, interior walls, and ceilings shall be sound and in good repair. All exterior wood surfaces, other than decay resistant woods, shall be protected from the elements and decay by non-lead base paint or by other protective covering or treatment. Walls shall be capable of affording privacy for the occupant.
         (a)   Every foundation, exterior wall, roof, and all other exterior surfaces shall be maintained in a workmanlike state of maintenance and repair and shall be kept in such condition as to exclude rodents.
         (b)   The foundation elements shall adequately support the building at all points.
         (c)   Every exterior wall shall be free of holes, breaks, loose, or rotting boards or timbers, and any other conditions which might admit rain or dampness to the interior portions of the walls or to the occupied spaces of the building. All exterior surface materials must be kept in a favorable state of repair.
         (d)   The roof shall be structurally sound, tight, and have no defects which might admit rain, and roof drainage shall be adequate to prevent rain water from causing dampness in the walls or interior portion of the building.
      (3)   Windows, doors and hatchways. Every window, exterior door, and basement hatchway shall be tight and shall be kept in sound condition and repair.
         (a)   Every window sash shall be fully supplied with glass window panes or an approved substitute which contains no open cracks or holes.
         (b)   Every window sash shall be in good condition and fit reasonably tight within its frame.
         (c)   Every window, other than a fixed window, shall be capable of being easily opened and shall be held in position by window hardware.
         (d)   Every exterior door, door hinge, and door latch shall be maintained in good condition.
         (e)   Access to or egress from each dwelling unit shall be provided without passing through any other dwelling unit.
         (f)   No person shall let to another for occupancy any dwelling or dwelling unit unless all exterior doors of the dwelling or dwelling unit are equipped with functioning locking devices. Locks which can be secured from the exterior of the apartment which cannot be unlocked from the interior are expressly prohibited.
         (g)   Every door available as an exit in any building shall be capable of being opened from the inside easily and without the use of a key.
         (h)   Every exterior door, when closed, shall fit reasonably well within its frame.
         (i)   Every window, door and frame shall be constructed and maintained in such relation to the adjacent well construction so as to exclude rain as completely as possible, and to substantially exclude wind from entering the dwelling or structure.
         (j)   Every basement hatchway shall be constructed and maintained so as to prevent the entrance of rodents, rain, and surface drainage water into the dwelling or structure.
      (4)   Screens. Every window or similar device shall be constructed so as to exclude insects during that portion of the year when there is a need for protection against mosquitoes, flies and other flying insects and provide adequate ventilation if needed.
      (5)   Fences. All fences shall be constructed of approved fencing material, shall be maintained in good condition and shall not create a harborage for rats. Wood materials shall be protected from decay by use of non-lead base paint or by other preservative material. The permissible height and other characteristics of all fences shall conform to the appropriate statutes, ordinances and regulations of the village and the state. Whenever any egress from the dwelling opens into the fenced area, there shall be a means of egress from the premises to any public way adjacent thereto.
      (6)   Accessory structures. Accessory structures present or provided by the owner, agent, or tenant occupant on the premises of a dwelling shall be structurally sound, and be maintained in good repair and free of insects and rats, or such structures shall be removed from the premises. The exterior of such structures shall be made weather-resistant through the use of decay-resistant materials or the use of lead-free paint or other preservatives.
      (7)   Chimney, flue, pipe, etc. Every chimney, flue, and smoke pipe and every other facility, piece of equipment, or utility which is present in a dwelling or dwelling unit, or which is required under this subchapter, shall be constructed and installed in conformance with the appropriate statutes, ordinances, and regulations of the village and the state.
      (8)   Conformance to law. All construction and materials, ways and means of egress, and installation and use of equipment shall conform with the appropriate statutes, ordinances and regulations dealing with fire protection of the village and the state.
   (B)   Interior requirements.
      (1)   Safety. Every interior floor, interior wall, ceiling, inside stair, every enclosed porch, and every appurtenance thereto, shall be safe to use and capable of supporting the loads that normal use may cause to be placed thereon; and shall be kept in sound condition and good repair. Every inside stair or step shall have uniform risers and uniform treads.
      (2)   Free from dampness. In every building, cellars, basements and crawl spaces shall be maintained reasonably free from dampness so as to prevent conditions conducive to decay or deterioration of the structure.
      (3)   Plumbing fixtures and pipes. Every plumbing fixture and all water waste pipes shall be properly installed and maintained in good sanitary working condition.
      (4)   Bathroom and kitchen floors. Every water closet compartment, bathroom and kitchen floor surface shall be constructed and maintained so as to be substantially impervious to water to prevent leaking into rooms adjacent or not and so as to permit such floor to be easily kept in a clean and sanitary condition.
      (5)   Structural members. The supporting structural members of every building shall be maintained structurally sound, showing no evidence of deterioration which would render them incapable of carrying the imposed loads.
      (6)   Interior stairs and railings. Stairs shall be provided in every structure if needed.
         (a)   All interior stairs of every structure shall be maintained in sound condition and good repair by replacing treads and risers that evidence excessive wear or are broken, warped, or loose. Every inside stair shall be so constructed and maintained as to be safe to use and capable of supporting a load.
         (b)   Every interior stairwell and every interior flight of stairs, which is more than two risers high, shall have handrails or railings. Every handrail or railing shall be firmly fastened and must be maintained in good condition. Properly balustraded railings, spaced no more than five inches apart, capable of bearing normally imposed loads, shall be placed on the open portions of the stairs, balconies, landings and stairwells.
      (7)   Sanitation. The interior of every dwelling and structure shall be maintained in a clean and sanitary condition free from any accumulation of rubbish or garbage. Rubbish, garbage and other refuse shall be properly kept inside temporary storage facilities as required under this subchapter.
      (8)   Fire/smoke detectors. In a multi-family dwelling, at least one single station smoke detector, properly placed within 15 feet of all sleeping areas, must be installed (see Chapter 18 of Life Safety Code, NFPA 72,2019 Edition, paragraph on existing apartment buildings for particular specifications).

§ 151.48 MAXIMUM DENSITY, MINIMUM SPACE, USE AND LOCATION REQUIREMENTS.
   No person shall occupy or let to be occupied any dwelling or dwelling unit for the purpose of living therein, unless there is compliance with the requirements of this section.
   (A)   Ceiling height. The ceiling height of any habitable room shall be at least seven feet; except that in any habitable room under a sloping ceiling at least one half of the floor area shall have a ceiling height of at least seven feet, and the floor area of that part of such a room where the ceiling height is less than five feet shall not be considered as part of the floor area in computing the total floor area of the room for the purpose of determining the maximum permissible occupancy.
   (B)   Basements. No basement space shall be used as a habitable room or a dwelling unit unless approved by the Police and Public Safety/Health and Property Chairperson in writing.
   (C)   Cellars. No cellar space shall be used as a habitable room or dwelling unit.
   (D)   Sleeping rooms. In every dwelling unit of two or more rooms, every room occupied for sleeping purposes by one occupant shall contain at least 70 square feet of floor space, and every room occupied for sleeping purposes by more than one occupant shall contain at least 50 square feet of floor space for each occupant thereof.
   (E)   Access. No dwelling or dwelling unit containing two or more sleeping rooms shall have such room arrangements such that access to a bathroom or water closet compartment intended for use by occupants of more than one sleeping room can be had only by going through another sleeping room; nor shall room arrangements be such that access to a sleeping room can be had only by going through another sleeping room. A bathroom or water closet compartment shall not be used as the only passageway to any habitable room, hall, basement or cellar or to the exterior of the dwelling unit.

§ 151.49 RESPONSIBILITIES OF OWNERS AND OCCUPANTS.
   (A)   Fitness. No owner or other person shall occupy or let to another person any dwelling or dwelling unit unless it and the premises are clean, sanitary, fit for human occupancy, and comply with all applicable legal requirements of the state and the village.
   (B)   Public area. Every owner of a dwelling containing two or more dwelling units shall maintain in a clean and sanitary condition the shared or public area of the dwelling and premises thereof.
   (C)   Private area. Every occupant of a dwelling or dwelling unit shall maintain in a clean and sanitary condition that part or those parts of the dwelling, dwelling unit and premises thereof that he or she occupies and controls.
   (D)   Screens, storm windows and doors. The owner of a dwelling unit shall be responsible for providing and handling all screens and double or storm doors and windows whenever the same are required under the provisions of this subchapter or any rule or regulation adopted pursuant thereto, except where there is a written agreement between the owner and occupant that provides otherwise. In the absence of such an agreement, maintenance or replacement of screens, storm doors and windows, once installed in any one season becomes the responsibility of the occupant. The occupant's responsibility shall be exclusive to his or her dwelling unit.
   (E)   Stored materials; dwelling or dwelling unit. No occupant of a dwelling or dwelling unit shall accumulate rubbish, boxes, lumber, scrap metal, or any other materials in such a manner that may provide a rat harborage in or about any dwelling or dwelling unit. Stored materials shall be stacked neatly in piles.
   (F)   Stored materials; multiple dwelling units. No owner of a dwelling containing three or more dwelling units shall accumulate or permit the accumulation of rubbish, boxes, lumber, scrap metal, or any other materials in such a manner that may provide a rat harborage in or about the shared or public areas of a dwelling or its premises. Materials stored by the owner or permitted to be stored by the owner shall be stacked neatly in piles.
   (G)   Transfer of cited property. It is unlawful for the owner of any dwelling unit who has received compliance orders or upon whom a notice of violation has been served, to sell, transfer, mortgage, lease or otherwise dispose of to another party the so cited property until the provisions of the compliance order or notice of violation have been complied with, or until such owner shall first furnish to the grantee, mortgagor or lessee a true copy of any compliance or notice of violation, issued by the Police and Public Safety/Health and Property Chairperson and shall furnish to the Police and Public Safety/Health and Property Chairperson a signed and notarized statement from grantees, transferee, mortgagor, or lessee, acknowledging the receipt of such compliance order or notice of violation and fully accepting the responsibility without condition for making the corrections or repairs required by such compliance order or notice of violation.
   (H)   Parking lot maintenance. All driveways and parking spaces for multi-family dwellings or lots containing two or more units shall be kept free of snow, ice, mud, or other debris at all times to lessen or avoid congestion on the public streets. All off-street parking areas shall be kept in condition as per the standards of the Village of Ramsey Code of Ordinances. Snow removed from an off- street parking lot(s) shall not be piled on the public right-of-way.
