1262.02   ZONING PERMIT REQUIRED; APPLICATION AND ISSUANCE; TIME LIMITATIONS ON WORK.
   (a)   No land use shall be commenced or changed, and no structure shall be erected, enlarged, moved or structurally altered, until a zoning permit has been obtained from the Zoning Administrator and the fee required for such a permit has been paid. An application for a zoning permit is available upon request from the Village Administrative Assistant at the Village Hall. Once the application has been returned to the Administrative Assistant at the Village Hall, the Zoning Administrator will be notified of its receipt. The Zoning Administrator will act upon it within seven days.
   (b)   Zoning permits shall be issued only in conformity with the provisions of this Zoning Code, unless the Zoning Administrator receives a written order from the Board of Zoning Appeals permitting a conditional use or variance.
   (c)   Each permit shall state that the permit shall expire and a new permit must be requested if work has not begun within six months or completed within one year. The Zoning Administrator may determine that delay in completion of work was justified and unavoidable and may issue a second permit. If work has not proceeded within the specified time restrictions after the issuance of the second permit, further permits must be approved by the Planning Commission.
   (d)   Failure of a zoning permit holder to complete the work as stated in the building permit application, or failure to occupy the building or premises in or upon which the permit was sought at the expiration of allowed permits, shall be deemed a violation of this section, punishable as provided in Section 1262.99 of the Planning and Zoning Code.

1262.03   PERMIT APPLICATION INFORMATION.
   Each application for a zoning permit shall contain the following information:
   (a)   The name, address and telephone number of the applicant.
   (b)   A legal description of the property.
   (c)   The existing use.
   (d)   The proposed use.
   (e)   The zoning district.
   (f)   Plot plans drawn to a scale of not less than fifty feet equals one inch, showing the actual dimensions and shape of the lot, the exact size and location of any existing and proposed buildings or structures, or any alteration.
   (g)   Building heights.
   (h)   The number of off-street parking spaces.
   (i)   The number of dwelling units.
   (j)   Any other materials that are necessary to determine whether the proposed project or use will comply with this Zoning Code.
   (k)   Signage.

1262.04   ZONING PERMIT AND RELATED FEES.
   Zoning and related fees are established or referenced as set forth herein and are not refundable except as otherwise stated herein. The Zoning Administrator shall provide a copy of the Village Zoning Ordinance upon application for any permit, excluding annual renewals of the Business Occupancy Permit, and payment of the applicable fee.
   (a)   Zoning Permits.
      (1)   A fee shall be charged for each zoning permit based on actual construction cost as follows:  For projects with construction costs up to and including ten thousand dollars ($10,000), the permit fee shall be seventy dollars ($70.00); for projects with construction costs exceeding ten thousand dollars ($10,000), the permit fee shall be seventy cents ($.70) per one hundred dollars ($100.00) of construction cost.
      (2)   At the time of initial issuance of a zoning permit, there shall be collected a fee, computed as provided herein, based on the estimated cost of construction.  If the actual cost of construction exceeds the estimated cost, there shall be collected, prior to the issuance of an occupancy certificate, the difference between the fee computed on the basis of actual cost and the amount previously paid.
      (3)   No permit fee will be refundable.
   (b)   Zone Change.  The permit fee to accompany a request for a zone change shall be five hundred dollars ($500.00).
   (c)   Board of Zoning Appeals.  The permit fee to accompany a request for a hearing before the Board of Zoning Appeals is two hundred fifty dollars ($250.00).
   (d)   Variance Request.  The fee accompanying a request for a zoning variance shall be two hundred fifty dollars ($250.00).
   (e)   Signs.  The fee for all signs requiring a permit is one hundred dollars ($100.00).
   (f)   Replat.  The fee accompanying a request for a replat shall be one hundred dollars ($100.00).
   (g)   Demolition Permit.  The fee accompanying a request for a demolition permit shall be one hundred dollars ($100.00).
   (h)   Zoning Code.  The fee for a complete copy of this Zoning Code is ten dollars ($10.00).
   (i)   Zoning Minutes.  The fee for zoning minutes is two dollars ($2.00) per copy.
   (j)   Antenna Application.  The fee for an antenna is fifty dollars ($50.00) as specified in Sections 1282.02(b)(7) and 1284.03(d).
   (k)   Business Occupancy Permit. The fee for an initial business occupancy permit, as required by Section 1262.05, shall be twenty-five dollars ($25.00), which shall be waived if the applicant is required to pay one of the other fees set forth in this section. The fee for an annual renewal of the business occupancy permit as required by Section 1262.05(c) or (d), shall be ten dollars ($10.00).
   (l)   All zoning permits and related fees issued by the Village will expire after one year from the time of issuance.

1262.05   BUSINESS OCCUPANCY PERMITS.
   (a)   If a zoning permit is required in reference to construction, erection, reconstruction, alteration or repair of a building or other structure, or a change of land or business use, owner or tenant, which does not require reconstruction, alteration or repair of a building or other structure, it shall not be lawful to use or occupy or permit the use or occupancy of such building, other structure or land until a business occupancy permit has been issued by the Zoning Administrator certifying that the business use, building or other structure complies with the provisions of this Zoning Code.
   (b)   Upon the substantial completion of the construction, erection, reconstruction, alteration or repair of a building or other structure for which a zoning permit was required and after the County Building Inspection Department has inspected and issued a County Certificate of Occupancy, or when such land or business use, or owner or tenant has been changed, an application for a business occupancy permit shall be made by submitting the Business Occupancy Permit Application, the applicable fee, as set by Section 1262.04, and a County Certificate of Occupancy. Within ten days after a Business Occupancy Permit has been applied for, the Zoning Administrator shall make an inspection of the premises and either grant or deny the permit. If the Zoning Administrator denies the permit, he or she shall state, in writing, the reasons for denial.
   (c)   Any existing or new business which does not conform to the use classification for its location, or has a Conditional Use permit, must submit a Business Occupancy Permit Application to the Zoning Administrator, and shall do so annually after the initial application.
   (d)   Any existing or new Home Occupation Business, as defined in Section 1260.05(16), in any residential district shall submit a Business Occupancy Permit Application to the Zoning Administrator, and shall do so annually after the initial application.
   (e)   The Business Occupancy Permit Application shall be in the following form:

1262.06   ENGINEERING INSPECTION FEES.
   (a)   On all commercial projects and such residential developments as are designated by the Zoning Administrator to be in need of an engineering and architectural inspection, the Village shall charge an inspection fee.  Said fee shall be used by the Village Engineer and the Village Architect for the inspection of the commercial project or residential development.  The inspection shall consist of, but not be limited to, a review of the basic plans for the improvement, a review of the plot development, storm and sanitary sewer layouts and street specifications and improvements, and design elements and other relevant issues, with the Village Engineer and the Village Architect reviewing those aspects of the project subject to their respective disciplines.  In addition, the Village Engineer and the Village Architect shall make such follow-up inspections as are necessary to ensure that the project is built according to State, County and Village standards.
   (b)   The inspection fee shall be based on the hourly fee of the Village Engineer and the Village Architect, as set forth in his or her contract with the Village.  Said fees shall be payable as billed by the Village and shall be paid in full before an occupancy permit is obtained by the owner.
   (c)   A basic contract form shall be available at the Village Hall and shall be signed by the owner or his or her designated agent and the Zoning Administrator at the time a zoning permit is obtained.
