(2) Safety. Antennas shall be constructed and installed to reasonably protect the safety of persons and property and to comply with this section, Building and Housing Code provisions and manufacturer's specifications. Notwithstanding antenna size, height and wind surface area, the antenna shall be capable of withstanding a wind of 100 miles per hour.
(3) Aesthetics. Council intends to preserve the image of fine homes, trees and other vegetation in the Residential Districts.
(b) Exemption. Roof-mounted antennas not exceeding five feet in size are exempt from the provisions of this section.
(a) No person shall construct, erect or move an antenna without first obtaining a conditional use permit from the Board of Zoning Appeals as required by Section 1264.05.
(b) Application for such a permit shall:
(1) Contain a site plan indicating the parcel number, address and the applicant's name along with the antenna type and its location with reference to lot lines, building set back and other existing structures.
(2) Include a copy of any required FCC license.
(3) Include the manufacturer's specifications or other substantiating evidence to determine the antenna's strength, stability, surface area, dimensions and capability to withstand a wind of 100 miles per hour.
(4) Provide details of support, guys, braces and method of attachment.
(5) Provide a method of grounding.
(6) Provide such other information as is necessary to determine compliance with this section.
(7) Be accompanied by the application fee set forth in Section 1262.04(j).
(8) Be accompanied by a written signed statement of the proposed installer indicating his or her knowledge of the requirements of this section and his or her intention to comply therewith.
(c) The Board shall hold a hearing and shall consider comments of contiguous owners and other owners of visually affected lots in the determination of the permit issuance or denial.
(a) No antenna or any component or support structure shall be located in the required front or side yard, nor project into any front or side yard or over any lot line.
(b) Not more than one free-standing antenna shall be permitted on any residential lot. Setback requirements for accessory structures shall be applied to corner lots.
(c) No free-standing antenna shall exceed forty feet in height above grade, nor shall any roof-mounted antenna exceed twenty feet above the highest ridge of the roof or forty feet above grade, whichever is greater.
(d) All underground wires shall be placed not less than twelve inches below grade; shall be low-voltage watertight cable or enclosed in watertight conduit, and shall not cross or be placed in easements or rights-of-way.
(e) No lettering, numbers, symbols, signs or designs shall be permitted on an antenna surface. Every antenna shall be color-compatible with the surrounding landscape and structures.
(f) Every free-standing antenna shall be electrically bonded to an eight-foot electrical ground rod, substantially all of which shall be embedded in the earth in a vertical attitude. All wiring shall conform to the National Electrical Code.
(g) Any electrical motor connected to an antenna shall be encased in protective guards and shall operate at a voltage no greater than 120 volts.
(h) Every free-standing antenna shall be mounted on either a concrete base in line with grade or caissons, depending upon soil conditions, to the approval of the Board of Zoning Appeals.
(i) All supporting structures shall be of aluminum, galvanized metal or the equivalent.
(j) Free-standing antennas shall not exceed a wind surface area of twenty-three square feet. Any antenna exceeding the height of the highest roof peak shall not exceed a wind surface area of eight square feet.
(k) Every antenna shall be constructed and installed to withstanding a wind of 100 miles per hour, and in accordance with the manufacturer's specifications and good engineering practice.
(l) Every free-standing antenna shall be screened with evergreen trees or shrubbery of such height, location or opacity as may be required by the Board.
(m) In any Residential District, no antenna shall be linked to any receiver which is not located on the same lot as such antenna.
