(a) The Planning Commission shall have the authority and responsibility to provide to the Board of Zoning Appeals a written finding of conformity or nonconformity of a replat request to this Zoning Code when a replat has been denied for size restraints imposed by current zoning restrictions.
Findings shall be submitted to the Board of Zoning Appeals within ten business days of such denial.
The Mayor and the Planning Commission Chairperson shall sign for approval of all replats, including variances.
(b) The Board of Zoning Appeals shall have the authority and responsibility to hear replat variances, where this Zoning Code permits a lot size smaller than the current restrictions imposed by ordinance.
The Board of Zoning Appeals shall approve or deny a replat request upon review of the replat and the findings of the Planning Commission pertaining to conformity to this Zoning Code.
Upon approval of a variance, the Board shall immediately submit such approval to the Planning Commission to proceed in the usual fashion for replat requests.
