SECTION A-601 FINES
A-601.1 Basic Fines: 166 Any person who violates any provision of this code or the technical codes or regulations adopted thereunder; or who fails to comply with any order issued pursuant to any Section thereof; or who erects, constructs, installs, removes, alters or repairs a structure, equipment or system in violation of the approved construction documents or directive of the code official or of a permit or certificate issued under the provisions of this code or the technical codes, shall be subject to a fine of three hundred dollars ($300) for each offense.
   1.   In addition to the Basic Fine, repeat violations of Section PM-301 ("General") or Section PM-302 ("Exterior Property Areas"), requiring more than one abatement of the same property in a twelve-month period, shall be subject to a penalty of one hundred dollars ($100) for each such repeat abatement action. 167
A-601.2 Fines for Class II offenses: 168 Notwithstanding Section A-601.1, any person who violates any of the following provisions shall have committed a Class II offense and be subject to the maximum fine set forth in subsection 1-109(2) of The Philadelphia Code:
   1.   Section F-106.4 (Rendering equipment inoperable);
   2.   Section F-106.4.1 (Fire Department notification);
   3.   Section F-104.2.2 (Obstructing operations);
   4.   Section F-106.7 (Obstructions);
   5.   Section F-307 (Open Burning and Recreational Fires);
   6.   Section F-308.5 (Open-flame devices);
   7.   Section F-901.4.6 (Changes to fire protection equipment);
   8.   Section F-901.7 (Systems out of service);
   9.   Section F-915 169 (Periodic Testing Of Fire Protection Systems);
   10.   Section F-1027 (Maintenance of the Means of Egress);
   11.   Section PM-702 (Means of Egress); 170

A-601.4 Separate offense: 192 Each day that a violation continues after issuance of a notice or order shall be deemed a separate offense.
A-601.5 Accrual of fines: 193 Each day that a violation continues after the time for correcting the violation as stated in the initial notice of violation has passed, and where no timely appeal has been filed pursuant to Section A-801 or Section A-803, shall be deemed a separate offense for purposes of determining the accrual of fines.
A-601.6 Imposition and accrual of fines: 194 If no timely appeal is filed from the issuance of a violation notice issued under this Section, the applicable fines set forth for such violation in this Section shall be deemed imposed for purposes of Section A-202.7 and Section A-503.1; all fines so imposed shall continue to accrue for each separate offense of each violation.

SECTION A-602 FACILITY LICENSE
A-602.1 Suspension: Any owner or operator of a facility licensed under this code or the technical codes who has been ordered to pay a fine pursuant to this Section and who has not paid such fine within 10 days of imposition of a final order from which all appeals have been exhausted shall have said license suspended and shall cease operations until all fines and costs are paid.
A-602.2 Cease operation: To enforce the provision of Section A-602.1, the department shall, without further notice, issue a Cease Operations Order setting forth the unpaid fines and costs and cause the premises to be vacated of all employees, patrons and occupants until all such fines and costs are paid. Such Cease Operations Order shall otherwise meet the requirements of and be subject to the procedures set forth in Section A-505.0.
