Utilities Generally
   EDITOR'S NOTE: Pursuant to Ordinance 173-02, passed July 15, 2002, the City Council approved the Natural Gas Deregulation Governance Plan for the purpose of establishing and implementing a Natural Gas Aggregation Program in the City. A copy may be obtained, at cost, at the Office of the Clerk of Council.

931.001   UTILITY COMPANY DEFINED.
   As used in this chapter, "utility company" means all other utilities except for telecommunications services, whether owned by any public or private or profit or nonprofit person, individual, firm, partnership, corporation, limited liability company, joint venture, trust, joint stock company, unincorporated association, governmental entity, banking institution, joint stock company, or any other organization of any kind, or voluntary association, whether organized or incorporated, specifically including, but not limited to, all other utilities defined as public utilities under Ohio R.C. 4905.02.

931.01   PERMIT FOR INSTALLATIONS.
   (a)   Any utility company desiring to make any installations whatsoever in the City shall first obtain both the approval of, and a permit from, the Director of Public Service.

   (b)   As a prerequisite to the issuance of a permit by the Director of Public Service for the installation of service equipment by a telephone company, as provided in subsection (a) hereof, the plans and the location must first be given in writing to the Ward Councilman in whose ward such equipment is being installed, and the Director of Public Service shall not issue a permit until he has a receipt in writing from the Ward Councilman acknowledging notification of the proposed location.
   (c)   In addition to the requirements of subsections (a) and (b) hereof, no utility company shall install service equipment upon private property without appropriately landscaping the area where such equipment is installed, if the owner or person in charge of such private property desires such landscaping. Such landscaping shall be subject to the approval of such owner or person in charge.
