No person who is the owner or occupant of lands within the Municipality shall repair, replace or construct a concrete or asphalt driveway apron or construct any private driveway or road in, across or through any public drainage ditch, drain, open storm sewer or natural watercourse within the limits of any public highway or private roadway without first obtaining a permit therefor from the Building Commissioner.

(a) No permit as provided in Section 1024.01 shall be granted unless, in constructing the private driveway or road, there is to be placed in the public drainage ditch, drain, open storm sewer or natural watercourse, a culvert, pipe or other device of such size and construction as will reasonably provide against the blocking, obstruction or improper diversion of water flowing therein.
(b) The Building Commissioner may prescribe the grade, length, position, dimensions and type of construction of a culvert, pipe or other device, having due regard to the terrain, the known and calculated volume of water flow and such other factors as may reasonably be expected to bear upon the use of such culvert, pipe or other device and the roadway or driveway in which it is to be installed.

If the Building Commissioner finds that any private driveway or road which has heretofore been constructed in, across or through any public drainage ditch, drain, open storm sewer or natural watercourse within the limits of any public highway has been constructed or is being maintained in such a manner that it is causing or is likely to cause obstruction, blocking or diversion of water flowing therein, he or she shall have the same authority as is conferred upon him or her in Section 1024.02(b) to order the owner or occupant of the land upon which such private driveway or road is located to repair or reconstruct the same, in such manner as will remove such obstruction, blocking or diversion of water. If his or her orders in such respect are not complied with within a reasonable time after written notice of them has been given to the owner or occupant, he or she shall report such failure to comply to Council.
