ALLOWANCE FOR THE SALE AND CONSUMPTION OF ALCOHOLIC BEVERAGES
ALLOWANCE FOR THE SALE AND CONSUMPTION OF ALCOHOLIC BEVERAGES
126.01 ALLOWANCE FOR THE SALE AND CONSUMPTION OF ALCOHOLIC BEVERAGES.
Events sponsored by a charitable 501(3)(c) corporation, community-wide promotional events sponsored by a 501(3)(c) corporation, and charitable or community-wide promotional events sponsored by a recognized charitable or community organization may be allowed to sell and consume alcoholic beverages in a public park, recreational facility, street, or other public property but only after first obtaining permission from the City Council and compliance with all of the following conditions:
1. Completed applications shall be filed with the City Administrator at least three (3) weeks before the event. A fee of twenty-five dollars ($25.00) shall be submitted with the application. The application will not be finally approved until all conditions have been met.
2. A detailed description of the event.
3. A detailed drawing showing the location of the event.
4. Payment of a minimum deposit of five hundred dollars ($500.00) to cover the cost of any repairs to public property. The deposit can be increased by the City Council when deemed necessary where the event is of such a size or nature to warrant an increase. The deposit will be refunded minus the cost of repairs, if any.
5. Compliance with all State laws and regulations must be met including that the appropriate State of Iowa license must be obtained. The event sponsor must be the same as the licensee.
6. Proof of liability and dram shop insurance must be provided in an amount established by the City Council. The City will be named as an additional insured on any liability policy and an agreement to hold the City harmless and indemnify it from all claims, losses or damages, including attorney fees, costs and expenses must be executed in the form provided by the City or otherwise approved by the City Attorney.
7. Alcohol will not be sold for consumption outside of the area designated in subsection 3. The area designated in subsection 3 will be fenced and controlled by the organization holding the event. Alcoholic beverages will not be allowed to leave the designated area.
8. Any other conditions deemed necessary by the City Council.
