8-1-6: WATER RATES AND CHARGES:
The rates and charges for the use of water and for the water services supplied by the Village, based upon the amount of water consumed as indicated by the water meters, is hereby established to be as follows: (Ord. 468, 6-8-1977, eff. 7-1-1977)
   A.   Within Corporate Limits: Each user of the waterworks system within the corporate limits of the Village of Monee shall be charged the sum of three dollars ($3.00) per one thousand (1,000) gallons of water used in excess of four thousand (4,000) gallons used per billing period, in addition to the minimum charge set forth hereafter. Said charges shall be billed every two (2) months (bi-monthly). There shall be a minimum two (2) month charge for water service in the amount of fourteen dollars fifty five cents ($14.55), irrespective of the amount of water used. Said rates shall be increased by five percent (5%) on an annual basis at the beginning of each fiscal year. (Ord. 1681, 5-28-2014)
   B.   Outside Corporate Limits: Each user of the waterworks system whose property is located outside of the corporate limits of the Village shall be charged the sum of five dollars sixty cents ($5.60) per one thousand (1,000) gallons of water used in excess of four thousand (4,000) gallons used per billing period, in addition to the minimum charge set forth hereafter. Said charges shall be billed every two (2) months (bimonthly) beginning July 1, 1993. There shall be a minimum two (2) month charge for water services in the amount of twenty one dollars twenty cents ($21.20) irrespective of the amount of water used. (Ord. 786, 4-14-1993)
   C.   Charge For Reading Meter: Each user of the waterworks system, both within and without the corporate limits of the Village, shall be charged the sum of ninety five cents ($0.95) per billing period, to cover the cost of reading of water meters, said amount to be added to each bimonthly bill.    D.   Charge For Failure To Connect To Water When Available:
      1.   The owner of any structure within the corporate limits of the Village, where Village water service is presently available or in the future becomes available to the premises, who declines to connect to the Village water system pursuant to the provisions of subsection
      2.   The owner of any premises subject to the minimum charge provided in subsection D1 of this section shall be liable to pay said minimum charge. (Ord. 565, 7-11-1984)
   E.   Emergency Repairs; Onetime Charge: Each user of the waterworks system of the Village shall be charged the sum of thirty one dollars ($31.00) as a onetime charge to cover the cost of certain emergency and extraordinary repairs to the water system, said amount to be added to each user's bill on the next billing date for water services.    F.   Request For Temporary Disconnection:
      1.   Voluntary Disconnection: Any residential, commercial or industrial real estate owner may complete a written request form and file the same with the Village Clerk seeking the disconnection of water services to their respective property. The written request form shall be furnished by the Village Clerk's Office.
      2.   Authority To Disconnect: Subject to the payment of the fees as set forth herein, the Water Superintendent is hereby authorized to disconnect the water service of a residential, commercial or industrial real estate owner provided that it is determined that the disconnection will not pose any danger to the public health and safety.
      3.   Disconnection/Reconnection Fees: The following fees are hereby imposed and must be paid prior to the Village providing said services:
         a.   Water disconnection fee: Fifty dollars ($50.00).
         b.   Water turn on fee: Fifty dollars ($50.00). (Ord. 1233, 6-25-2003)
Said water disconnection fee and water turn on fee may be waived on a onetime basis per year for residential customers. Any such customer seeking a waiver shall provide written notice to the Village Clerk as to when the water supply should be disconnected and then reconnected. If a resident customer is delinquent with any water, sewer or grass cutting bill due the Village, he or she will not be eligible for this waiver. (Ord. 1524, 1-27-2010)
      4.   Release Of Claim: The Village shall not be responsible or liable for any claims, demands, or causes of action which may arise, directly or indirectly, as a result of disconnecting or turning on the water supply. (Ord. 1233, 6-25-2003)
   G.   Water Rate Fee; Fire Flow Testing: The charge for water used by metered service from fire hydrants and the estimated water use for fire flow testing shall be three dollars fifty cents ($3.50) per one thousand (1,000) gallons. (Ord. 1338, 1-12-2005)
8-1-6-1: SECURITY DEPOSITS ON RENTAL PROPERTIES:
   A.   Purpose Of Security Deposit: The security deposit shall be filed with the Village Clerk to ensure and guarantee prompt payment of the water bill for water furnished to the leased property. (Ord. 1459, 10-24-2007)
   B.   Definitions: Whenever used in this section, the following words and phrases shall have the meanings as described below:
    LEASED PROPERTY: Any leased or rented improved property of any kind including residential, industrial or commercial facilities.
   LESSEE/TENANT: An individual or other entity who leases or rents a residence, industrial or commercial facility.
   C.   Security Deposit:
      1.   Residential Unit: Prior to occupying a residential unit, the lessee or tenant shall be required to deposit the sum of two hundred fifty dollars ($250.00) with the Village Clerk.
      2.   Commercial Unit: Prior to occupying a commercial unit, the lessee or tenant shall be required to deposit the sum of five hundred dollars ($500.00) with the Village Clerk.
      3.   Industrial Unit: Prior to occupying an industrial unit, the lessee or tenant shall be required to deposit the sum of one thousand dollars ($1,000.00) with the Village Clerk. (Ord. 1461, 11-14-2007)
   D.   Security Deposit Fund: Any and all security deposit monies shall not be commingled with general corporate funds. A separate account shall be established reflecting receipt of any security deposit monies in accordance with section 8-1-9 of this chapter.
   E.   Return Of Security Deposit: The Village Clerk shall be authorized to return the security deposit monies to an owner of record of leased property upon a sale of the same.
   F.   Penalties: Any person found to be in violation of any provision of this section shall be fined not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00) per offense. Additionally, the Village shall have the right to terminate water service to a rental property until there is compliance herein. (Ord. 1459, 10-24-2007)

8-1-6-2: ADMINISTRATIVE FEE:
An administrative fee of fifty cents ($0.50) per billing cycle shall be hereby assessed for utility services invoices. Said charge shall be increased by five percent (5%) on an annual basis at the beginning of each fiscal year. (Ord. 1680, 5-28-2014)
8-1-6-3: TRANSFER OF OWNERSHIP OF PROPERTY:
   A.   Definitions: For the purpose of this section, the following words shall have the meaning given to them:
    PROPERTY: Any residential unit, including mobile homes, industrial, manufacturing, commercial or retail facility located within the Village.
   UTILITY SERVICES: Services including the furnishing of water, sewer, grass cutting, and garbage disposal.
   B.   Liability: Purchasers of property which has accumulated unpaid bills for utility service are liable, as subsequent owners of the property, for the unpaid charges for the prior service, plus any fees or fines related thereto. Future utility service will be denied if said amounts are not paid upon purchase, and/or the Village may act to foreclose any utility lien filed against the property. (Ord. 1658, 9-11-2013)
8-1-7: JOINT LIABILITY FOR PAYMENT OF CHARGES:
The owner of the premises, the occupant thereof, and the user of the water service shall be jointly and severally liable to pay for the water supplied to each premises and the water service is furnished to the said premises by the Village only upon condition that the owner of the premises, occupant and user of the services are jointly and severally liable therefor to the Village. 8-1-8: BILLING PROCEDURES AND DELINQUENCIES:
Water rates or charges for water services shall be billed and payable bimonthly in the following manner:
   A.   Bimonthly Billing: Bills for water services shall be rendered for bimonthly readings ending February 28, April 30, June 30, August 31, October 31, and December 31 of each year. (Ord. 1173, 1-9-2002)
   B.   Penalty For Late Payment: The Village Treasurer shall mail billings to each owner, occupant or user between the first and fifteenth days of January, March, May, July, September and November, for the two (2) month period ending on the last day of the preceding month. A late charge of thirty dollars ($30.00) shall be added to any bill in which payment is not received within thirty (30) days of the date of mailing. If payment is not received by the due date, a "second and final bill before shutoff" will be generated, indicating the total amount due, with a due date no later than fifteen (15) days from date of mailing. The water supply may be suspended if the owner, occupant or user fails to remit timely payment to the Village as so specified in the "second and final bill" and the outstanding balance exceeds thirty one dollars ($31.00). The water service shall not be reinstated until any and all past water billings together with a one hundred dollar ($100.00) service charge is remitted to the Village Treasurer. The Village Treasurer shall indicate on the bill the date after which the late charge will be assessed. Billings for such services may be combined with billing for sewer service charges or garbage collection charges, if applicable, and payment of combined billing shall be applied first to sewer service charges, then to garbage collection charges, and finally to water service charges.    C.   Delinquency; Lien: In the event the charges for services are not paid within thirty (30) days after the date of mailing, such charges shall be deemed and are hereby declared to be delinquent, and thereafter such delinquencies shall constitute a lien upon the real estate for which service is supplied. The Village Clerk, upon being directed to do so by the Village Administrator, is hereby authorized and directed to file a notice of such lien in the Office of the Recorder of Deeds of Will County, as provided in 65 Illinois Compiled Statutes 5/11-139-8.    D.   Authority To Discontinue Water Service; Notice; Fee: (Rep. by Ord. 1596, 3-14-2012)
   E.   Request For Meter Test; Fee: In the event any owner, occupant or user of Village water services is of the opinion that the water meter on the premises being served is not accurate, he may, by depositing fifty dollars ($50.00) with the Village Treasurer, request a test of said meter. If, upon such test, the meter is found to be accurate, said fee shall be forfeited to the Village as cost of such test, but if the meter is found to be inaccurate, said fee shall be returned to the property owner and the meter properly adjusted to register accurately.
   F.   Inaccurate Meter Reading; Billing Averaged: Whenever it is found that a meter has been registering inaccurately or has not registered since the last reading, the individual authorized to issue billings as provided in section 8-1-5 of this chapter, with the consent of the committee, shall render a billing based on the average for previous periods or based on water consumption of a similar water user. 8-1-9: BILLING AND COLLECTION FOR SERVICES:
   A.   Rendition Of Bills: The Village Treasurer or an appropriate individual directed by the Board of Trustees shall render bills for water services and to collect all monies due thereon. (Ord. 525, 11-25-1980; amd. 1999 Code)
   B.   Water Fund: All revenues and monies collected or derived from the operation of the water system shall be turned over to the village treasurer and held by the treasurer in a separate fund designated as the "village of Monee water fund" and said treasurer shall administer such fund in every respect in the manner provided by the provisions of the Illinois Compiled Statutes.
   C.   System Of Accounts; Annual Audit: The village treasurer shall establish a proper system of accounts and shall keep proper books, records, and accounts in which complete and correct entries shall be made of all transactions relative to the water system, and at regular annual intervals, shall cause an audit of said accounts to be made by an independent auditing concern to show the receipts and disbursements of the water system.
