8-1-2: COMMITTEE ON WATER; SUPERVISION AND DUTIES:
   A.   General Oversight: The Water Committee, with the assistance of the Village Administrator, shall be charged with the oversight of the entire waterworks system throughout the Village. The Water Committee shall also review any and all rules and regulations that may be applicable to the operation of the system.
   B.   Duties And Powers Of Committee:
      1.   The Water Committee shall monitor and oversee the budget expenditures allocated to the Water Department periodically during each fiscal year.
      2.   The committee shall develop and recommend policies in an effort to implement and maintain efficient operations of the Village water system. Said policies shall be forwarded to the Village Board for review and input.
      3.   The committee shall develop new and/or modify existing ordinances and make recommendations to the Village Board for review and input.
      4.   The committee shall hold a strategy and planning meeting at least once per fiscal year for the discussion of maintenance and future needs of the Village of Monee waterworks and water system. (Ord. 1573, 10-26-2011)
8-1-3: APPLICATION AND FEES FOR WATER CONNECTION:
   A.   Connection Required; Exceptions: Every owner of a structure within the corporate limits of the Village wherein water services are required by this Code, and where there is available Village water service to the premises, shall be connected to the Village water service, within six (6) months of the date that the water mains are available for connection to the premises, except in the following specific cases:
      1.   Where on July 11, 1984, there was no Village water service connected to the premises, and there was an existing operating private well, the owner of such a well may use same to provide water services to the premises as long as said well remains operable. In the event that such existing well becomes inoperable, or where there is a need to drill a new private well or extend the existing well, or in the event that the ownership of the premises is transferred, then in any of the said events, the premises shall be connected to the village water service within the time period above provided.
      2.   Where there is a new construction of a structure within the village where no village water service is then available, the owner of the premises shall notify the village in writing of the owner's intention to use water services for the premises, and the village shall have the option for thirty (30) days, from the date of notice, to either agree to provide water service to the premises, or waive its right to provide said service. If the village determines not to provide water service to the premises, the owner of the premises shall have the right to install a well or to obtain water service from a source other than the village to service the premises. Nevertheless, it shall be required that the owner provide the village with written notice as described above, before the installation of a well or to obtain other than village water service.    B.   Application And Fees For Connection: All applications for connection to village water service shall be filed with the village clerk, on forms provided by the village, and shall as soon as reasonably possible thereafter be referred to the director of water and sewer for his approval. A tap-in fee for connection in the following amounts shall accompany each application:
      1.   Newly Available Service: Where water service is newly made available to a resident user's premises by the village, the tap- in fee shall be the sum of two thousand three hundred dollars ($2,300.00), provided an application is made and water connected to the subject premises within one hundred twenty (120) days of the water system becoming operational. If application is made within the one hundred twenty (120) day period and the premises are not connected to the water service within said period, or if no application is made during said period, the fee shall thereafter be two thousand five hundred dollars ($2,500.00).
      2.   Resident Users: The tap-in fee for resident users shall be two thousand five hundred dollars ($2,500.00).
      3.   Nonresident Users: The tap-in fee for nonresident users shall be the sum of three thousand dollars ($3,000.00).
      4.   Developments:

   C.   Approval Or Disapproval Of Application: The director of water and sewer shall have the right to approve or disapprove any application based on the particular circumstances and costs involved and shall report his decision to the water committee who shall make the final determination as to whether the connection shall be allowed. In the event the water committee disapproves an application for connection, the fees paid therefor shall be refunded to the applicant.
   D.   Fees Deposited In Certain Accounts: The fees collected under the provisions of this section shall be deposited into two (2) separate accounts. The accounts shall be known as "capital expansion" account, and as "inspection" account. The portion to be deposited into each account shall be as herein specified:

8-1-4: INSTALLATION OF WATER SERVICE:
Upon the director of water and sewer and the water committee approving an application for water service and connection, the necessary installation of systems to provide service shall be as follows: (Ord. 468, 6-8-1977, eff. 7-1-1977; amd. Ord. 1249, 9-10-2003)
   A.   Residents: The fee paid by a resident user for water service and connection shall entitle him to connect to the existing distribution system a water line of whatever size the committee deems necessary. The resident user shall install said line, at his own expense, from whatever point on the existing distribution system the committee directs, to the property being serviced. The resident user shall also, at his own expense, make necessary connections to the existing distribution system and install necessary curb boxes and cocks to complete the connection. The committee shall have the authority to establish where such water lines will be installed from the existing distribution system to the resident user's property being serviced.    B.   Nonresidents: The fee paid by a nonresident user for water service and connection shall entitle him to connect to the existing distribution system a water line of whatever size the committee deems necessary. The nonresident user shall install said line, at his own expense, from whatever point on the existing distribution system the committee directs, to the property being serviced. The nonresident user shall also, at his own expense, make necessary connections to the existing distribution system and install necessary curb boxes and cocks to complete the connection. The committee shall have the authority to establish where such water lines will be installed from the existing distribution systems to the nonresident user's property line. 8-1-5: WATER METERS:
   A.   Installation And Maintenance:
      1.   Furnishing Of Meters; Village Or User Expense: The village shall furnish, install, and seal all necessary water meters of a size five-eighths inch (5/8") or less at village's expense. Any necessary water meters in size in excess of five-eighths inch (5/8") shall be furnished by the user, at user's expense, but shall be installed and sealed by the village.
      2.   Meters Property Of Village: All water meters shall become and remain the property of the village thereafter.
      3.   Village Determine Size And Location: The committee shall have the authority to establish the location of all meters on the user's property and the size of meter required to service the property.
      4.   Maintenance By Property Owner: The property owner and users shall exercise care so that water meters will not be damaged by freezing or other causes and in the event that such meters are damaged by freezing or otherwise, the property owner and users shall reimburse the village for the cost of repair or cost of installing a new meter, if necessary.       5.   Water Service Connection: The water committee shall determine as to whether a single or multiple service water connection will be required to be installed in each facility being constructed or remodeled within the village. Each water service connection shall be tapped into the water main and extended into the facility it serves. Each facility service connection shall have its own separate meter setting. The proposed service size, type of construction, location and connection charge shall be approved by the director of the water department. Any such work done without the approval of the director of the water department shall be illegal and a stop work order may be issued.
In the event it is determined that the domestic water usage exceeds the maximum flow of a service size, the director of the water department may require a larger service size to be installed at the owner's sole expense. (Ord. 1337, 1-12-2005)
      6.   Damage Or Destroy Water Seal: It shall be prohibited for the property owners or users to damage, alter, modify or destroy the water seal located on the property in any manner without the permission of the water department supervisor. Violators shall be subject to a fine of not less than seven hundred fifty dollars ($750.00) nor more than one thousand five hundred dollars ($1,500.00) per incident. (Ord. 1367, 8-10-2005)
   B.   Inspection And Reading:
      1.   Time For Reading: It shall be the duty of the village to have all water meters read and inspected by authorized village employees bimonthly and at such other times as may be necessary for the proper submitting of bills for water service. All readings of water meters are to be submitted to an appropriate individual for billing as directed by the board of trustees, said billing to be as provided hereinafter.       2.   Right To Turn Off Water: The committee on water or the board of trustees of the village shall have the right, through their authorized employees, to turn on or off all water service whenever necessary for repair of the systems or safety of the village residents or property and also in the event of nonpayment of water bills or other violation of this chapter as hereinafter provided. (Ord. 468, 6-8-1977, eff. 7-1-1977)
      3.   Right Of Access To Property: The following provisions shall apply to the reading of meters:
         a.   Duty Of Occupant To Allow Access: The occupants of any premises where water services are provided by the village, and where the water meter is located within the residence or building being serviced, shall allow the duly authorized village meter reader access into the residence or building for the purpose of reading the meter at all reasonable times. The said meter reader shall furnish identification if requested. In the event the meter reader is unable to read the meter at the regularly scheduled bimonthly periods, the village may estimate the water usage for the particular meter in question, based upon the prior usage. In the alternative, the village may leave a notice at the residential building requesting the occupants to notify the village of a convenient time for the reading of the meter.          b.   Failure To Respond To Village Notices; Fee: In the event the meter reader has left notices to the occupants of any premises for which water is furnished by the village on two (2) separate consecutive occasions, and the occupant has failed to arrange with the village for the reading of the meter in question, the village may continue to estimate the water usage for the subject premises and assess a service charge of five dollars ($5.00) for each subsequent bimonthly billing during which the meter reader is unable to read the said meter. Said service charge shall be added to the estimated billing during the subsequent bimonthly readings until the meter can be read. The village shall send a written request together with the bimonthly billing on which a service charge is assessed, requesting the occupant or individual responsible for payment of the bill, to contact the village to arrange the reading of said meter. Failure to comply with said request will result in sanctions and penalties as provided in subsection B3c of this section. In the event it is determined that any water service is discontinued, the water user, or customer, shall have no claim, cause of action, lawsuit or demand against the Village and its officers that may arise as a result of said disconnection.          c.   Authority To Discontinue Water Service; Notice; Hearing: In the event the Village has caused the notices as provided in subsection B3b of this section to be left or served upon the occupants of the premises and the Village is unable to read the said meter for two (2) successive bimonthly readings, the Committee on Water shall have the authority to direct a discontinuance of water services to the subject premises. Prior to directing a discontinuance of such water services, the Committee on Water shall send notice to the owner, occupant or user and hold a hearing on a date certain regarding the discontinuance of the water services, as provided in the case of nonpayment for water services under subsection

8-1-6: WATER RATES AND CHARGES:
The rates and charges for the use of water and for the water services supplied by the Village, based upon the amount of water consumed as indicated by the water meters, is hereby established to be as follows: (Ord. 468, 6-8-1977, eff. 7-1-1977)
   A.   Within Corporate Limits: Each user of the waterworks system within the corporate limits of the Village of Monee shall be charged the sum of three dollars ($3.00) per one thousand (1,000) gallons of water used in excess of four thousand (4,000) gallons used per billing period, in addition to the minimum charge set forth hereafter. Said charges shall be billed every two (2) months (bi-monthly). There shall be a minimum two (2) month charge for water service in the amount of fourteen dollars fifty five cents ($14.55), irrespective of the amount of water used. Said rates shall be increased by five percent (5%) on an annual basis at the beginning of each fiscal year. (Ord. 1681, 5-28-2014)
   B.   Outside Corporate Limits: Each user of the waterworks system whose property is located outside of the corporate limits of the Village shall be charged the sum of five dollars sixty cents ($5.60) per one thousand (1,000) gallons of water used in excess of four thousand (4,000) gallons used per billing period, in addition to the minimum charge set forth hereafter. Said charges shall be billed every two (2) months (bimonthly) beginning July 1, 1993. There shall be a minimum two (2) month charge for water services in the amount of twenty one dollars twenty cents ($21.20) irrespective of the amount of water used. (Ord. 786, 4-14-1993)
   C.   Charge For Reading Meter: Each user of the waterworks system, both within and without the corporate limits of the Village, shall be charged the sum of ninety five cents ($0.95) per billing period, to cover the cost of reading of water meters, said amount to be added to each bimonthly bill. (Ord. 811, 5-11-1994)
   D.   Charge For Failure To Connect To Water When Available:
      1.   The owner of any structure within the corporate limits of the Village, where Village water service is presently available or in the future becomes available to the premises, who declines to connect to the Village water system pursuant to the provisions of subsection
      2.   The owner of any premises subject to the minimum charge provided in subsection D1 of this section shall be liable to pay said minimum charge. (Ord. 565, 7-11-1984)
   E.   Emergency Repairs; Onetime Charge: Each user of the waterworks system of the Village shall be charged the sum of thirty one dollars ($31.00) as a onetime charge to cover the cost of certain emergency and extraordinary repairs to the water system, said amount to be added to each user's bill on the next billing date for water services. (Ord. 706, 10-10-1990)
   F.   Request For Temporary Disconnection:
      1.   Voluntary Disconnection: Any residential, commercial or industrial real estate owner may complete a written request form and file the same with the Village Clerk seeking the disconnection of water services to their respective property. The written request form shall be furnished by the Village Clerk's Office.
      2.   Authority To Disconnect: Subject to the payment of the fees as set forth herein, the Water Superintendent is hereby authorized to disconnect the water service of a residential, commercial or industrial real estate owner provided that it is determined that the disconnection will not pose any danger to the public health and safety.
      3.   Disconnection/Reconnection Fees: The following fees are hereby imposed and must be paid prior to the Village providing said services:
         a.   Water disconnection fee: Fifty dollars ($50.00).
         b.   Water turn on fee: Fifty dollars ($50.00). (Ord. 1233, 6-25-2003)
Said water disconnection fee and water turn on fee may be waived on a onetime basis per year for residential customers. Any such customer seeking a waiver shall provide written notice to the Village Clerk as to when the water supply should be disconnected and then reconnected. If a resident customer is delinquent with any water, sewer or grass cutting bill due the Village, he or she will not be eligible for this waiver. (Ord. 1524, 1-27-2010)
      4.   Release Of Claim: The Village shall not be responsible or liable for any claims, demands, or causes of action which may arise, directly or indirectly, as a result of disconnecting or turning on the water supply. (Ord. 1233, 6-25-2003)
   G.   Water Rate Fee; Fire Flow Testing: The charge for water used by metered service from fire hydrants and the estimated water use for fire flow testing shall be three dollars fifty cents ($3.50) per one thousand (1,000) gallons. (Ord. 1338, 1-12-2005)
8-1-6-1: SECURITY DEPOSITS ON RENTAL PROPERTIES:
   A.   Purpose Of Security Deposit: The security deposit shall be filed with the Village Clerk to ensure and guarantee prompt payment of the water bill for water furnished to the leased property. (Ord. 1459, 10-24-2007)
   B.   Definitions: Whenever used in this section, the following words and phrases shall have the meanings as described below:
    LEASED PROPERTY: Any leased or rented improved property of any kind including residential, industrial or commercial facilities.
   LESSEE/TENANT: An individual or other entity who leases or rents a residence, industrial or commercial facility.
   C.   Security Deposit:
      1.   Residential Unit: Prior to occupying a residential unit, the lessee or tenant shall be required to deposit the sum of two hundred fifty dollars ($250.00) with the Village Clerk.
      2.   Commercial Unit: Prior to occupying a commercial unit, the lessee or tenant shall be required to deposit the sum of five hundred dollars ($500.00) with the Village Clerk.
      3.   Industrial Unit: Prior to occupying an industrial unit, the lessee or tenant shall be required to deposit the sum of one thousand dollars ($1,000.00) with the Village Clerk. (Ord. 1461, 11-14-2007)
   D.   Security Deposit Fund: Any and all security deposit monies shall not be commingled with general corporate funds. A separate account shall be established reflecting receipt of any security deposit monies in accordance with section 8-1-9 of this chapter.
   E.   Return Of Security Deposit: The Village Clerk shall be authorized to return the security deposit monies to an owner of record of leased property upon a sale of the same.
   F.   Penalties: Any person found to be in violation of any provision of this section shall be fined not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00) per offense. Additionally, the Village shall have the right to terminate water service to a rental property until there is compliance herein. (Ord. 1459, 10-24-2007)

8-1-6-2: ADMINISTRATIVE FEE:
An administrative fee of fifty cents ($0.50) per billing cycle shall be hereby assessed for utility services invoices. Said charge shall be increased by five percent (5%) on an annual basis at the beginning of each fiscal year. (Ord. 1680, 5-28-2014)
8-1-6-3: TRANSFER OF OWNERSHIP OF PROPERTY:
   A.   Definitions: For the purpose of this section, the following words shall have the meaning given to them:
    PROPERTY: Any residential unit, including mobile homes, industrial, manufacturing, commercial or retail facility located within the Village.
   UTILITY SERVICES: Services including the furnishing of water, sewer, grass cutting, and garbage disposal.
   B.   Liability: Purchasers of property which has accumulated unpaid bills for utility service are liable, as subsequent owners of the property, for the unpaid charges for the prior service, plus any fees or fines related thereto. Future utility service will be denied if said amounts are not paid upon purchase, and/or the Village may act to foreclose any utility lien filed against the property. (Ord. 1658, 9-11-2013)
8-1-7: JOINT LIABILITY FOR PAYMENT OF CHARGES:
The owner of the premises, the occupant thereof, and the user of the water service shall be jointly and severally liable to pay for the water supplied to each premises and the water service is furnished to the said premises by the Village only upon condition that the owner of the premises, occupant and user of the services are jointly and severally liable therefor to the Village.
