10-4-1: ADOPTION OF CODE:
There is hereby adopted, as a portion of the building regulations for the village, the international mechanical code, 2021 edition, with the exception of section 109 entitled "Means Of Appeal", being a compilation of the rules and regulations prepared by the International Code Council for the regulation of the design, installation, maintenance, alteration, and inspection of mechanical systems that are permanently installed and utilized to provide control of environmental conditions and related processes within buildings and to regulate those mechanical systems, system components, equipment and appliances specifically addressed in the mechanical code. One copy of said mechanical code is on file in the office of the village clerk and is available for public use, inspection and examination. (Ord. 1570, 9-17-2012; amd. Ord. 1776, 11-6-2023)
10-4-2: PERMIT REQUIREMENTS:
   A.   Permit Required; Fees: No person, firm or corporation shall design, install, maintain, or alter any mechanical systems without first obtaining a permit from the mechanical inspector. The following is a list of fees for obtaining such permits:

1.   Or the total hourly cost to the jurisdiction, whichever is the greatest. This cost shall include supervision, overhead, equipment, hourly wages and fringe benefits of the employees involved.

   B.   Eligibility For Permit: In order to be eligible to obtain a permit, any person, firm, or corporation engaging in or performing heating, ventilation, cooling and refrigeration work within the village shall register in the office of the inspector of heating and air conditioning and shall file with his application a surety bond to be approved by the village attorney in the sum of ten thousand dollars ($10,000.00) conditioned to indemnify and save harmless the village from the results of any acts of the applicant engaging in or performing heating, ventilation, cooling and refrigeration work within the village. Such bond shall be written for a minimum of one year and shall be renewable in January of each year thereafter.
   C.   Issuance To Owners Of Single-Family Dwellings: Any permit required by this chapter may be issued to any person to do any work regulated by this chapter in a single-family dwelling used exclusively for living purposes including the usual accessory buildings and quarters in connection with such buildings; provided, that the person is the bona fide owner of such dwelling, and that the same is occupied by said owner; and provided further, that said owner shall personally purchase all material and perform all labor in connection therewith; and provided, that all workmanship, methods and materials shall meet the requirements of the heating, ventilation, cooling and refrigeration regulations of the village. 10-4-3: VIOLATIONS:
   A.   The failure or neglect to comply with the provisions of this chapter and of the permit issued under the provisions of this chapter shall be considered a violation of this chapter.
   B.   Any person duly licensed as required by this chapter to supervise or perform any installation of work governed by the terms of this chapter and who shall, as such licensee, take out or secure a permit such as is required by this chapter for work to be done by any person not connected with such licensee and not in the employ of said licensed person, or who shall allow his name to be used by any other person for the purpose either of doing any such work or obtaining a permit therefor, shall, by such act, upon suspension by the inspector of heating and air conditioning, forthwith forfeit his license, and the inspector of heating and air conditioning shall thereafter refuse to issue any further permits to construct, install, alter or repair any heating or air conditioning plant or equipment under any license forfeited.
   C.   Any person who shall install in any building, structure or enclosure in the village any apparatus, article or equipment for heating, ventilation, cooling and refrigeration, as defined in this chapter, which does not comply with the requirements of this chapter shall be guilty of a violation of the terms of this chapter. 10-4-4: PENALTY:
The violation of any of the terms and provisions of this chapter shall be punishable by a fine as provided in section 1-4B-1 of this code, and each day a violation occurs or is permitted to occur shall constitute a separate violation. (Ord. 1570, 9-17-2012; amd. Ord. 1776, 11-6-2023)
