The Mayor has power to:
(A) Nominate and, with the consent of the Council, appoint all non-elective officers of the city provided for by the City Council, except as provided by the statutes of the state;
(B) Suspend and, with the consent of the City Council, remove any non-elective officer, stating in the suspension or removal the cause therefor;
(C) Supervise the discharge of all official duty by all subordinate officers;
(D) Request that the governor call out the militia to aid the mayor in suppressing riots or other disorderly conduct, preventing and extinguishing fires, securing the peace and safety of the city or town or carrying into effect any law or ordinance (M.C.A. § 7-4-4403);
(E) To appoint, with the advice and consent of the City Council:
(1) One City Treasurer;
(2) One Chief of Police; and
(3) Any other officers necessary to carry out the provisions of the ordinances of the city and the statutes of the state.
(F) Cause the ordinances of the city to be executed;
(G) Approve all ordinances and resolutions of the City Council adopted by it;
(H) Veto any objectionable part of a resolution or ordinance and approve the other parts;
(I) In case an ordinance or resolution does not meet the Mayor’s approbation, the Mayor has power to return the same to the next regular meeting of the City Council with all objections in writing. No ordinance or resolution so vetoed by the Mayor shall go into effect unless the same be afterwards passed by two-thirds of the full number of members of the City Council;
(J) If the Mayor fails to return any resolution or ordinance as above set forth, the same takes effect without further action;
(K) Communicate to the City Council at the beginning of every session, and more often if necessary, a statement of the affairs of the city with such recommendations as the Mayor deems proper;
(L) Recommend to the City Council such measures connected with the public health, cleanliness and ornament of the city, and the improvement of the government and finances as the Mayor considers expedient;
(M) Call special meetings of the City Council. When so called by the Mayor, the Mayor must state by message the object of the special meeting and the business of the meeting shall be restricted to the object stated;
(N) Cause to be presented, once in three months, a full statement of the financial condition of the city;
(O) Bid for the city on any property sold at a tax or judicial sale whenever the city is an interested party;
(P) Procure and have in his or her custody the seal of the city or town;
(Q) Take and administer oaths;
(R) Perform such other duties as may be prescribed by law or by resolution or ordinance of the City Council;
(S) The Mayor is the presiding officer of the Council and must sign the journals thereof and all warrants on the city treasury; and
(T) To decide all ties which may result from the vote of the City Council. The Mayor has no other vote.

The Mayor has power to grant pardons and remit fines and forfeitures for offenses against city ordinances when, in the Mayor’s judgment, public justice would be so served. The Mayor must report all pardons granted, with the reasons therefor, to the next City Council meeting.

The Mayor is authorized and empowered to sign his or her name officially for, and on behalf of, the city on all contracts, including deeds, bonds, bills, notes, obligations and other agreements, documents and instruments to which the city is a party, and to require that the conditions and the said instruments are faithfully performed, and to borrow money on the credit of the city when authorized by the City Council.

The Mayor shall have the power, when he or she deems it necessary, to require any officer of the city to exhibit his or her accounts or other papers, and to make reports to the Council in writing touching upon any subject or matter pertaining to his or her office.

(A) The City Council shall hold its open public regular meetings for the transaction of municipal business on the second and fourth Tuesdays of each month commencing at a time set by resolution. The Mayor or, in his or her absence, the President of the City Council shall convene and call the City Council meeting to order. In the absence of both the Mayor and President of the City Council, the City Council may appoint one of its number to act in his or her place. All meetings shall be held in a place provided therefor by City Council.
(B) If a quorum City Council is convened by either the physical presence of the members or by means of electronic equipment, such as a conference call; and if the City Council will hear, discuss or act upon a matter over which it has supervision, control, jurisdiction or advisory power, then the meeting must be open to the public and the press must be permitted to photograph, televise or record the proceedings of the meeting, and legally sufficient minutes of the meeting must be kept and made available for the public.
