§ 32.169 RESERVED.
§ 32.170 FUTURE BENEFITS TO RETIRED MEMBERS UNDER FIREFIGHTERS PENSION FUND.
   (A)   The plan set forth hereunder shall be used as a basis for granting future benefits to retired members and their dependents and beneficiaries who are eligible for benefits under the Louisville Firefighters Pension Fund hereinafter referred to as the "Fund".
   (B)   (1)   Each year the Fund Actuary shall complete the regular actuarial valuation of the Fund. The effective date of the valuation shall be January 1.
      (2)   By April 1 of each year, the Pension Board of Trustees shall submit a copy of its annual actuarial report as of January 1 of that year, prepared in compliance with all applicable state laws, to the Louisville Metro Chief Financial Officer.
   (C)   The assets of the Louisville Firefighters Pension Fund shall be used exclusively for the benefit of the Fund members and their beneficiaries who are eligible to receive benefits under the Fund. Such assets shall include those formerly referred to by ordinance as the "Cumulative Pension Reserve Account", the "Excess Cumulative Pension Reserve", and the "Surplus Pool".
   (D)   Effective July 1, 2006, and on July 1 of each year thereafter, a recipient of a retirement allowance under Louisville Metro Code of Ordinances Chapter 32 shall have his or her retirement allowance increased by the percentage increase in the annual average of the consumer price index for all urban consumers for the most recent calendar year as published by the Federal Bureau of Labor Statistics, not to exceed 5%. In determining the annual employer contribution rate, only the cost of increases granted as of the most recent valuation date shall be recognized. The benefits of this subsection as provided on July 1, 2005, and thereafter shall not be considered as benefits protected by the inviolable contract provisions referenced in KRS 78.852. The Metro Council reserves the right to suspend or reduce the benefits conferred in this subsection if in their judgment the welfare of the Metro Government so demands.

§ 32.171 TEMPORARY PAYMENTS TO CERTAIN RETIRED MEMBERS AND BENEFICIARIES.
   (A)   Insurance reimbursements. Each retired member or beneficiary of a retired member who is receiving a monthly annuity shall be eligible to receive a monthly reimbursement not to exceed that amount equal to the maximum Metro Government contribution ever allocated to the cost of health insurance for employees covered under the classification and compensation ordinance for any single-coverage premiums that the annuity recipient pays out-of-pocket for his or her own health insurance coverage.
   (B)   Conditions of payments.
      (1)   Payment of the insurance reimbursement is subject to the appropriation of funds in future years for said payment.
      (2)   To qualify for the insurance reimbursement, the annuity recipient must provide documentation that shows his or her single-coverage health insurance premium payments for the time period such reimbursements are sought.
      (3)   The cost of the insurance reimbursements shall be reimbursed to the Louisville Firefighters Pension Fund by the Metro Government, upon receipt of proper documentation from the Fund, which shall include the names, amounts and dates of payments to each recipient.
      (4)   The benefits described in this section shall not be taken into consideration in the annual actuarial valuation of the Fund.

§ 32.172 REVIEW AND REVISIONS.
   It is the intent that the Louisville Firefighters Retirement Fund will review the actuarial assumptions with specific regard to mortality tables and investment return assumptions in consultation with the Louisville Metro Finance Department on an annual basis, and will revise as deemed necessary.

COMMISSION FOR PERSONS WITH DISABILITIES
§ 32.190 ESTABLISHMENT.
   The Louisville Metro Commission for Persons with Disabilities ("the Commission") is hereby established with the following purpose and authority:
   (A)   Advise the Mayor and the Council on issues of access, representation, employment, housing and quality of life affecting citizens with disabilities and their families;
   (B)   Serve as a resource for citizens with disabilities and their families to express concerns and solutions regarding issues affecting them;
   (C)   Publicize the role of the Commission for people with disabilities and the resources available to assist citizens with disabilities, employers, housing representatives, business owners, engineers and architects, and others who have a role in bettering the community;
   (D)   Promote awareness to the general public of the capabilities, needs and desires of citizens with disabilities;
   (E)   Publicly recognize the efforts of employers, businesses, schools, organizations, individuals, and others who have demonstrated outstanding support of programs and services for citizens with disabilities;
   (F)   Serve as advocate for accessibility issues and implementation of plans and projects to improve services for citizens with disabilities;
   (G)   Advise Louisville Metro departments and divisions on policy matters which affect the daily lives of people with disabilities, especially with regard to public facilities; and
   (H)   Make recommendations to the Mayor and Council as it deems appropriate.

§ 32.191 MEMBERSHIP.
   (A)   The Commission shall consist of 13 members. Members shall be appointed by the Mayor with the approval of the Louisville Metro Council. The 13 appointed members shall include the following: two members from Louisville Metro Council; four members from organizations or individuals representing people with disabilities; one member representing the business community; one member representing a regional college or university; one member representing rehabilitation professionals; two members from employment and/or education advocacy organizations; and two members from the community at large. An ADA coordinator for Louisville Metro Government or designee, the Director of Metro Parks or designee, the Director of Public Works or designee and the Director of Develop Louisville or designee shall serve as ex-officio members.
   (B)   The appointment term of each Commission member shall be four years, except for initial appointment terms. Initial appointment terms shall be staggered as follows: two members appointed to one year terms; two members appointed to two year terms; and one member appointed to a three year term.
   (C)   Members shall serve without compensation.
