§ 32.164 RIGHTS OF BENEFICIARIES OF PRIOR LEGISLATION.
   No former member or beneficiary of a former member who severed employment prior to July 1, 1984, shall have his or her rights or benefits either increased or decreased or otherwise affected by this amended subchapter. The rights to such pension shall be based on the statute or ordinance creating the pension. After July 1, 1973, any dependent of a presently pensioned member who becomes eligible for the pension of such member shall proceed pursuant to this subchapter but the amount of pension shall remain unchanged. Provided, however, that effective July 1, 2001, a person who retired between July 1, 1979 and July 1, 1984 and who was disabled in the line of duty and who receives a worker's compensation award, shall not have such award deducted (or offset) from the portion of any pension benefits, as provided in § 32.161 and as otherwise provided in this subchapter, to be paid to said person or to the dependent of said person after said effective date.
