§ 97.008 UNSAFE SCAFFOLDING.
   Whoever shall erect or use or cause or suffer to be erected or used, within the city, any insecure or unsafe scaffold, whereby the safety of persons working thereon or passing thereunder may in any manner be endangered, shall be deemed guilty of creating a nuisance.

§ 97.009 AWNINGS; HEIGHT AND CONSTRUCTION.
   (A)   All awnings above any street or sidewalk in the city shall be set not less than eight feet above the grade of such street or sidewalk and shall be securely supported by iron brackets or iron framework firmly attached to the building so as to leave the sidewalk or street wholly unobstructed and so as to permit it being rolled up close to the wall of the building. No awning shall project over any sidewalk to exceed three-fourths of the width thereof nor shall any such awning be allowed to remain in such condition as to endanger or inconvenience persons passing under or near the same. Any awning in the city not constructed or set in accordance with the requirements of this section is hereby declared to be a nuisance.
   (B)   Any awning, sign, signboard, flag or other sign fixture in the city already erected or placed and not in accordance with the requirements of this chapter is hereby declared to be a nuisance.

§ 97.010 TRANSPORTATION OF MATERIALS ALONG OR UPON STREETS.
   Any person hauling any material along or upon the streets, avenues or alleys of the city shall so construct, keep and maintain the means of conveyance thereof so that at no time shall any of said material so hauled be dropped or spilled onto said streets, avenues or alleys. Any person hauling trash or any other material along or upon the streets, avenues or alleys of the city which trash or material is to be deposited in the Kewanee landfill or any other landfill shall cover the means of conveyance thereof with a tarp or other like material so that at no time shall any of said trash or other material so hauled be dropped, spilled or allowed to fall or blow onto said streets, avenues or alleys. Any person failing or refusing to comply with the terms of this section shall be deemed guilty of a misdemeanor.

§ 97.011 TRACTION ENGINES; MOVING OVER STREETS.
   (A)   It shall be unlawful for any person to take or move into or through any street or alley in the city, any traction engine, bulldozer or excavator without first obtaining a permit so to do, as required by this section.
   (B)   Any person desiring a permit, shall make application in writing to the City Clerk describing the route over which it is proposed to move any such traction engine or bulldozer or excavator. Before issuing any such permit provided for herein, the Clerk shall require a bond for not less than the sum of $500 with one or more sureties to be approved by the Clerk, conditioned to indemnify, save and keep harmless the city from and against all liabilities, suits, judgments, costs, damages and expenses which may in any way arise or come against the city in consequence of the granting of any such permit, and for the repair of any street or sidewalk that might be injured, and for the compliance of all provisions of this code pertaining to the moving of such traction engines and bulldozers or excavators in and across and through the streets of the city. Upon receiving such application and bond as required by this chapter, the Clerk shall issue a permit to the party applying for the same. The permit when granted, shall be delivered to the Street Commissioner, and such official notified when such traction engine or bulldozer or excavator is to be moved through or across the streets of the city.
   (C)   No person shall move any traction engine, bulldozer, or excavator across any pavement or sidewalk or brick crossing without first sufficiently planking the same so as to protect such pavement, sidewalk or crossing from damage. No person receiving any such permit shall, while running such traction engine, bulldozer or excavator, sound any whistle or allow any steam to escape in such manner as to annoy any person, and shall at all times have a competent person in charge thereof, and a person a sufficient distance in advance of such traction engine, bulldozer or excavator to warn persons of its approach and to provide for the safety of passing vehicles and persons; provided, that nothing in this section shall apply to engines or locomotives running on any railroad, sidetrack or switch in the city.

§ 97.012 INSTALLATION OF STREET LIGHTS.
   Every dedicated street (alleys excluded) intersection shall have a street light for which the city will pay the electric bill. If the distance between intersections is greater than 500 feet, then street lights will be placed so that the distance between lights is no greater than 500 feet. The type of light will be determined by the City Manager, or his designee, based on the recommendation of the utility company with respect to the most energy efficient light. Installation of lights and if necessary new poles will be subject to budget considerations. Priority for new lights and poles will be given to areas where residents pay the city for the initial cost of installing a new light and if necessary a new pole. This provision shall not be construed so as to give a right to any person to demand the installation of a street light or pole whether the light is requested for an existing street, a new subdivision or along a new street.

§ 97.013 HONORARY STREET NAME SIGN PROGRAM.
   As a way to honor Kewanee residents who died while serving our country in the armed services, there is hereby established an honorary street name sign program as described below. All honorary street name signs shall comply with the guidelines of this program. Honorary street name signs shall not have the effect of changing platted street names or official addresses.
   (A)   Application process.
      (1)   To request an honorary street sign designation, citizens must fill out an application for the sign.
      (2)   Members of the surviving family requesting the honorary sign must be Kewanee residents at the time of application.
      (3)   The person being honored must have been a Kewanee resident.
      (4)   The person being honored must have died in combat as determined by the U.S. Department of Defense.
      (5)    Applications are to be as promulgated by the City Manager.
      (6)   Completed applications shall be filed with the City Manager.
   (B)   Honorary Street Sign Advisory Committee.
      (1)    In order to allow proper review of any honorary sign application received, there shall be created an advisory committee to be known as the Honorary Street Sign Advisory Committee.
         (a)   The Honorary Street Sign Advisory Committee shall consist of the following persons: Police Chief, Fire Chief, Public Works Department Head, City Manager, and one representative of the Kewanee Veterans Council.
         (b)    The Honorary Street Sign Advisory Committee shall review all applications received, and make recommendations to the City Council as to type of honorary sign to be placed, if any; the location(s) of the sign; and the date for the unveiling ceremony for the sign.
         (c)   This Committee is advisory in nature only.
      (2)   The City Council reserves full and final authority regarding honorary street signs and the funding therefor.
   (C)   Approval process.
      (1)   Upon submission of an application, the Honorary Street Sign Advisory Committee will provide a letter to the applicant acknowledging receipt of the application, and explaining the approval process.
      (2)   The Committee shall cause letters to be sent to residents living in the vicinity of the proposed honorary street sign location to inform them of the proposed sign.
      (3)   If approved, the honorary street sign will be installed on a street sign pole at both ends of a city block. The sign color shall be brown background with white letters and any other ornamentation as deemed appropriate.
      (4)   The applicant will be notified of the outcome of the application review. If an honorary street sign is approved by the City Council, the proclamation establishing the sign shall contain information as to the date of its installation and unveiling ceremony.
   (D)   Administrative list.
      (1)   To supplement the application process in division (A) above, there shall be maintained by city administrative staff a list of all those Kewanee residents listed by the U. S. Department of Defense as having died in combat.
      (2)   For those whose names appear on this administrative list but for whom no application as described in division (A) above has been submitted, the Honorary Street Sign Committee shall be the applicant, and signs shall be erected for those on the administrative list, subordinate to applications received per division (A) above, and subject to available funding as budgeted on an annual basis.
