§ 95.23 RECORDS TO BE KEPT.
   (A)   It shall be the duty of the Secretary of the Board of Health to record all returns of contagious and infectious diseases in a book to be provided for that purpose.
   (B)   It shall be unlawful for the Secretary to fail, refuse or neglect to keep these records.

BIRTHS AND DEATHS
§ 95.35 BIRTH REPORTS.
   (A)   All physicians, accoucheurs and midwives in the city are hereby required to report to the Secretary of the Board of Health of the city within 5 days thereafter, all births which may occur in their practice and it shall be unlawful for any physician, accoucheur or midwife to fail, refuse or neglect to within that time report all births.
   (B)   Whenever any birth occurs that no physician, accoucheur, or midwife attends, the birth shall be reported to the Secretary of the Board of Health within 5 days thereafter by the householder under whose observation the birth may occur. It shall be unlawful for any householder to fail, refuse or neglect to make this report.
   (C)   Any person required to report any birth shall, in addition to the fact of the birth, report the sex and race of the person born and the name and nativity of the parents, if known.

§ 95.36 DEATH REPORTS.
   (A)   All physicians are hereby required to report to the Secretary of the Board of Health of the city within 24 hours thereafter all deaths which may occur in their practice in the city, except when death may occur from a contagious or infectious disease when they shall report within 6 hours. It shall be unlawful for any physician to fail, refuse or neglect to so report within the times aforesaid.
   (B)   Whenever any death occurs that no physician has attended the case or is in attendance then the death shall be reported to the Secretary of the Board of Health within 24 hours or if the death has occurred from any infectious or contagious disease within 6 hours by the householder under whose observation the death may occur. It shall be unlawful for any householder to fail, refuse or neglect to report the death within the above time limits.
   (C)   In all cases of death when the coroner has held an inquest and the death has not been reported by a physician, the coroner shall report the death, within 24 hours after holding an inquest, to the Secretary of the Board of Health.
   (D)   Any person required by this chapter to report any death, in addition to the fact of the death, shall report the name of the deceased if known, the sex, race and age as nearly as may be, nativity, whether married or single, duration of last sickness, date and cause of death, if known, and place of residence. It shall be unlawful for any person to fail, refuse or neglect to report these facts.

§ 95.37 BURIAL PERMITS.
   (A)   It shall be unlawful for any undertaker or other person to bury the body of any deceased person within the city or remove any body for burial out of the city without a permit from the Board of Health so to do.
   (B)   This permit shall be issued to the undertaker or other person by the Board of Health when and where only the facts regarding the death of the deceased person have been reported to the Secretary of the Board as provided in this chapter.

§ 95.38 REPORTS TO COMMON COUNCIL.
   It shall be the duty of the Board of Health at the first meeting of the Common Council in each month to substantially report a true copy of the record of the deaths and births of the preceding month which shall be read and filed with the records of the Common Council.

§ 95.39 RECORDS TO BE KEPT.
   It shall be the duty of the Secretary of the Board of Health to record all returns of births and deaths in a book to be provided for that purpose. It shall be unlawful for the Secretary to fail, refuse or neglect to keep these records.

§ 95.40 FEES FOR COPIES OF RECORDS.
   (A)   The Health Department of the city shall collect service fees as follows:
      (1)   Birth certificate: $12 each.
      (2)   Death certificate: $12 each.
      (3)   Searches (including genealogy): $25 each.
      (4)   Affidavit of amendments: $25 each.
      (5)   Court orders: $25 each.
      (6)   Paternity affidavits: $25 each.
      (7)   Notifications, birth to 2 years: $25 each.
   (B)   All fees collected shall be accounted for and transferred to the Health Fund of the city’s Health Department.
