ADOPTING ORDINANCE

ORDINANCE NO. 8691

   AN ORDINANCE TO APPROVE AND ADOPT A HAMMOND CITY CODE

   WHEREAS, the City Clerk of the City of Hammond has caused to be prepared by American Legal Publishing Co., Cincinnati, Ohio (“American Legal”), a single volume codification of the ordinances of the City of Hammond (“City”); and

   WHEREAS, American Legal has prepared such a volume and presented it to the City of Hammond for adoption as a new codification of the City's ordinances; and

   WHEREAS, it is the intent of the Common Council of the City to adopt such volume as a codification of the city's ordinances;

   NOW, THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF HAMMOND as follows:

   1.)   The looseleaf, three ring volume printed and published in 2005 by American Legal be and is hereby adopted and approved by reference, as if here set out in its entirety, as the codified version of the ordinances of the City.

   2.)   This volume shall be known as the “Hammond City Code” or “The Code of Ordinance of the City of Hammond, Indiana.”

   3.)   Until existing supplies of pre-printed notices of ordinance violations are exhausted, but in no event later than one year after the effective date of this ordinance, any police officer or other employee or official of the City, may continue to use such existing supplies of pre-printed notices of ordinance violations, not withstanding that numbered references may be to the prior version of the Hammond City Code and not the version adopted by this ordinance. Any such references to the prior version of the Hammond City Code shall be construed as referring correctly to the newly adopted Hammond City Code.

   4.)   If any part, paragraph, sentence or provision of this ordinance shall be held invalid, the remainder shall not be affected.

   5.)   This ordinance shall be effective upon final passage by the Common Council, approval of the Mayor, or override of any Mayoral veto, and its publication (if required) as provided by law.
