1440.01   DEFINITIONS.
   As used in this chapter:
   (a)   "Person" means any firm, association, organization, partnership, trust, company or corporation as well as any individual.
   (b)   The present tense includes the future tense and the singular includes the plural and the plural the singular.
   (c)   "Shall" is mandatory and "may" is permissive.
   (d)   "Used" or "occupied" includes "intended, designed or arranged to be used or occupied."
   (e)   "Building" includes "structure."
   (f)   "Dwelling" includes "residence."
   (g)   "Lot" includes "plot" or "parcel."
   Terms not herein defined shall have the meanings given in Article 3.02 of the Zoning Ordinances, being Ordinance 72-46, passed May 9, 1972.

1440.02   ZONING PERMIT OR CERTIFICATE OF OCCUPANCY REQUIRED.
   No use of any land or improvement of any building or structural change outside of the existing walls of any building shall be made and no structure shall be placed, erected or located on any platted or unplatted lands unless the structure, improvement or use and the location thereof conform to the Zoning Ordinance (Ordinance 72-46, passed May 9, 1972) and unless a zoning permit or a certificate of occupancy for the structure has first been obtained from the Director of Public Safety and Service and/or the Mayor. No contractor or subcontractor shall enter into the performance of any contract with any owner or lessee of any building or lot in the City for the improvement of any structure or lot until such owner, lessee or an agent of either has first obtained and posted, in clear view on the street side of the premises, a zoning permit issued by the Director and/or the Mayor as required by the Zoning Ordinance (Ordinance 72-46, passed May 9, 1972).

1440.03   FILING OF PLANS.
   Every application for a zoning permit shall be accompanied by lot layout plans in duplicate, drawn to scale in ink or in blueprint form, showing the lot number, the street name, the street number, the property owner's name, the size, shape and location of all permanent monuments and the exact dimensions of the lot to be built upon; the exact location, size, shape and height of the main building and of all accessory buildings, existing or proposed, and the line within which buildings or structures are to be constructed, erected or altered; the existing and intended use of each building or parts of the building; the number of family or housekeeping units the building is designed to accommodate; and such other information with regard to the lot and neighboring lots as may be necessary to determine and provide for the enforcement of the Zoning Ordinance (Ordinance 72-46, passed May 9, 1972).

1440.04   APPROVAL OF PLANS.
   All dimensions shown on the lot layout plans and the application shall be based on an actual survey of the lot and shall show the location of all permanent monuments, the lot lines and any existing easements. The location of all proposed structures shall be staked out on the ground. The Zoning Inspector shall inspect the staked out area to see if it conforms to that shown on the plans and the application before such application is approved.

1440.05   ZONING PERMIT ISSUANCE.
   Upon approval of the plans and the application by the Director of Public Safety and Service and/or the Mayor, a zoning permit and an application for a certificate of occupancy shall be issued to the applicant.

1440.06   INSPECTION OF FOOTING.
   If the improvement for which the zoning permit was issued requires a footing, the contractor shall notify the Zoning Inspector twenty-four hours in advance of starting any construction above such footing, stating the exact location of the footing, so that the Inspector can inspect it to determine if the actual construction is the same as that shown on the approved plans and the application for the zoning permit. No person shall place any construction above a footing that has not been inspected.
