137.01 ESTABLISHED.
   (a)   There shall be a Civil Service Commission comprised of three members who shall be appointed by the Mayor and confirmed by Council. No more than two members shall be of the same political party. The first appointees shall be appointed for terms of one, two and three years respectively. Thereafter all appointments shall be for three year terms. Each member of the Commission shall hold office until his successor is appointed and qualified. Vacancies shall be filled by appointment for the unexpired term. Members shall be residents of the City, but no officer or employee of the City shall be eligible for appointment to this Commission. A member of the Commission may be removed by the affirmative vote of a majority of Council after being given a written statement of the charges against him and a hearing, which shall be a public hearing, if he so requests.
   (b)   Members of the Commission shall serve without pay, but shall be reimbursed for necessary expenses.
   (c)   The Commission shall annually elect its chairman and such other officers as it desires from among its members and shall establish its own rules of procedure; provided, that two members shall constitute a quorum for transaction of business and two affirmative votes shall be required for final action of any matter acted upon by the Commission.

137.02 POWERS AND DUTIES.
   The Civil Service Commission shall have power and shall be required to:
   (a)   Advise the Mayor, Council and Personnel Director on matters concerning personnel administration, including training programs and the fostering of interest by educational institutions and civic, professional and employee organizations in the improvement of the City service.
   (b)   Review the personnel rules and regulations and amendments thereto developed and recommended by the Personnel Director; conduct hearings thereon; approve or reject such rules in whole or in part and with or without modifications; and transmit such rules with recommendations to Council for its consideration and legislative action where appropriate.
   (c)   Hear appeals by any employee in the classified service from a decision by the appointing authority with respect to a discharge, suspension or a reduction in classification or pay; and report in writing to the appealing employee and the appointing authority its findings and decisions, which decisions shall be binding upon the appointing authority.
   (d)   Make any investigation which it may consider desirable concerning personnel administration in the City service and report to the Mayor and Council its findings, conclusions and recommendations.
   (e)   Perform such other related duties as may be necessary to fulfill its responsibilities or as may be assigned by the Mayor or Council.
   (f)   For purposes of conducting any hearing or investigation authorized by this article, administer oaths, subpoena witnesses and compel the production of pertinent records and books.

137.03 PERSONNEL DIRECTOR.
   (a)   The Mayor shall appoint a Personnel Director. The Personnel Director shall be the administrative head of the Personnel Department. He shall be responsible for the proper conduct of all administrative affairs of the Personnel Department and for the execution of the personnel program. In the case where an individual serves as Mayor and City Manager, this individual shall be the Personnel Director.
   (b)   The Director, as executive head of the Personnel Department, shall direct and supervise all its administrative and technical activities, in addition to the duties imposed upon him elsewhere in this article, it shall be his duty:
      (1)   To apply and carry out the rules adopted by the Civil Service Commission.
      (2)   To establish and maintain a roster of all employees in the City civil service, in which there shall be set forth, as to each employee, the class title, pay or status and other pertinent data.
      (3)   To appoint such employees of the department and such experts and special assistants as may be necessary to carry out effectively the provisions of this article and the rules of the Commission.
      (4)   To foster and develop, in cooperation with appointing authorities and others, programs for the improvement of employee effectiveness, including training, safety, health, counseling and welfare.
      (5)   To make available to the public, information about vacancies in the classified service and to strive constantly to attract to the career service of this City, people of highest ability.
      (6)   To investigate from time to time the operation and effect of this article and of the rules made hereunder and to report his findings and recommendations to the Commission and to the Mayor.
      (7)   To make an annual report regarding the work of the department, and such special reports as he may consider desirable, to the Commission.
      (8)   To perform any other lawful acts which may be necessary or desirable to carry out the purposes and provisions of this article and the rules made hereunder.
      (9)   To designate appropriate persons, including officers and employees in the City service, to assist in the preparation and rating of tests.
