After the display, the firing crew shall conduct an inspection of the fallout area for the purpose of locating unexploded aerial shells or live components. This inspection shall be conducted before public access to the site shall be allowed. Where fireworks are displayed at night and it is not possible to inspect the site thoroughly, the operator or designated assistant shall inspect the entire site at first light.

Any shells found during the inspection required in post-display inspection shall not be handled until at least 15 minutes have elapsed from the time the shells were fired. The fireworks shall then be doused with water and allowed to remain for at least an additional five minutes before being placed in a bucket or fiberboard box. The disposal instructions of the manufacturer as provided by the fireworks supplier shall then be followed in disposing of the fireworks.

If for any reason of unfavorable weather or unsafe conditions as determined by the Township Code Official, the event may be canceled or postponed. Any decision to cancel or postpone the event shall be done at least three hours prior to the scheduled start time. The permitted operator shall be responsible to immediately implement appropriate actions to notify the general public of the cancellation or postponement of the display.

Any person, partnership, association, group, or any organization or group of individuals violating any provision of this chapter shall, upon conviction thereof before a District Justice, be liable for the payment of a fine of not more than $1,000, plus the costs for prosecution, for each offense and, in default of payment of such fine and costs for prosecution, shall undergo imprisonment of not more than 30 days in the county jail. A separate offense shall arise for each day or portion thereof in which a violation is found to exist or for each section of the ordinance which is found to have been violated.

The applicant shall have the right to appeal the denial of a permit to the Township Board of Supervisors. A written notice of appeal shall be filed with the Township within 30 days of the receipt of the notice of denial. The Board of Supervisors shall then act upon the appeal at its next regularly scheduled meeting following receipt of the notice of appeal. The Board of Supervisors will hold a Local Agency Law hearing pursuant to 2 Pa.C.S. §101 et seq., and will render a written decision within 10 days from the date such hearing concludes. Any person aggrieved by a decision of the Township Board of Supervisors may appeal to a court of competent jurisdiction pursuant to the Local Agency Law (2 Pa.C.S. §101 et seq.), and 42 Pa.C.S. §933(a)(2).
