Sec. 6.5-45. Nonconforming uses.
   A structure which was lawful constructed at an elevation below the elevation of the base flood before the passage or amendment of this article, or the use of a structure or premises which lawfully commenced prior to the adoption or amendment to this article, which is not in conformity with the provisions of this article, may be continued so long as it remains otherwise lawful, subject to the following conditions.
   (a)   No such use or structure shall be expanded, changed, enlarged or altered in a way which increases its nonconformity.
   (b)   No substantial improvement of any nonconforming structure shall be permitted, unless the structure is permanently changed to a conforming use.
   (c)   If any nonconforming use or structure is destroyed by any means, including but not limited to floods, to an extent of fifty percent (50%) or more of its value, it shall not be reconstructed except in conformity with the provisions of this article.
   (d)   Any alteration, addition or repair to any nonconforming structure which would result in substantially increasing its flood-damage potential shall be prohibited.
