Sec. 4.5-13. Change in regulatory status.
   (a)   If the operator believes it is subject to effective competition as defined in 47 C.F.R. § 76.905, it may petition the FCC for a change in its regulatory status pursuant to 47 C.F.R. Sec. 907. At the time it initiates its petition, the operator shall forward a copy of its petition to the city via certified mail. The operator bears the burden of proving the existence of effective competition.
   (b)   If the operator files a petition for a change in regulatory status, the city shall within fifteen (15) days provide public notice of the filing of the petition.
