7-1-1: LEGISLATIVE AUTHORITY:

Provisions of this title governing traffic, parking, and public transportation are enacted under the authority of the state constitution, the city's police powers, and provisions of the state Vehicle Code. (1962 Code § 3-4.101)

7-1-2: COUNCIL AUTHORITY:

Council action shall be required to implement any traffic regulation only when an ordinance or resolution is specifically required by state law, with the following exceptions:

   A.   The designation of any street or alley as one way only, or any change in the direction of an existing one-way street or alley shall require approval by the city council prior to implementation.

   B.   The designation of any street, other than those streets specified in section 7-2-203 of this title, for use by vehicles having a gross weight, including the vehicle and its load, in excess of three (3) tons shall require approval by city council prior to implementation. (1988 Code)

7-1-3: AUTHORITY OF TRAFFIC AND PARKING COMMISSION:

The traffic and parking commission shall have the authority and responsibility as set forth in title 2, chapter 2, article 7 of this code, and shall perform the following specific functions:

   A.   The designation of any intersection requiring a vehicle to come to a full stop, or the installation or removal of any existing stop sign within the city, shall require approval by the traffic and parking commission prior to implementation;

   B.   Hear appeals from any decision of the transportation/engineering official in granting or denying a permit under this title, where an appeal from such decision is appealable to the traffic and parking commission; and

   C.   Perform such other functions and duties as set forth in this title. (1988 Code)

7-1-4: AUTHORITY AND DUTIES OF THE TRANSPORTATION OFFICIAL:

   A.   The transportation official shall have the authority and duty to implement such traffic and parking regulations as necessary or appropriate to facilitate traffic and parking within the city, and to install, modify or remove any traffic devices; provided, further, that where council approval is required by section 7-1-2 of this chapter, or traffic and parking commission approval is required prior to implementation, such approval shall be given prior to implementation and enforcement. Traffic and parking regulations implemented by the transportation official shall be consistent with governing federal and state laws, provisions of this code, and consistent with any direction of the city council or the city manager.

   B.   The transportation official shall have authority to issue parking permits as authorized by this title.

   C.   The transportation official shall be responsible for posting such signs as required by the city, or by the state Vehicle Code, and traffic or parking regulations shall not be implemented or enforced until such signs are properly posted.

   D.   For purposes of this title, "transportation official" shall mean the director of transportation. (1962 Code §§ 3-4.103, 3-6.701, 3-6.901, amd. Ord. 99-O-2340, eff. 1-7-2000)

7-1-5: AUTHORITY OF POLICE:

   A.   Police officers shall have the power and authority at all times in cases of emergency or the sudden or unusual temporary use of streets or traffic congestion to close, open, reroute, or otherwise regulate the traffic or parking on all or any portion of any public street or alley.

   B.   Whenever the police chief shall determine that any emergency congestion may result from the holding of public or private assemblages, gatherings, or functions, or for other reasons, the police chief shall have the power and authority to order temporary signs posted prohibiting the operation, parking, or stopping of vehicles on such streets or alleys.

   C.   Whenever the police chief determines that the holding of a private assemblage, gathering, or function necessitates the parking of automobiles associated with such event in a residential zone with restricted parking requirements, written parking authorization, not exceeding six (6) hours may be granted for such event, subject to such conditions as appropriate to protect the public health, welfare, and safety. 7-1-6: AUTHORITY OF FIRE PERSONNEL:

Authorized fire personnel shall have the power and authority in any situation involving an emergency response by the fire department to close, open, or regulate traffic and parking on all or any portion of any public street or alley. (1962 Code § 3-6.301)

7-1-7: AUTHORITY OF CITY MANAGER:

Whenever the city manager determines that the holding of a public or private assemblage, gathering, or function necessitates the parking of automobiles associated with such event in a parking zone with restricted parking requirements, temporary parking authorization may be granted by the city manager for such event, without regard to the parking restrictions, subject to appropriate conditions to protect the public health, welfare and safety. 7-1-8: ENFORCEMENT AUTHORITY:

Police officers and such other personnel as authorized by the city shall have authority to enforce the provisions of this title. (1962 Code § 3-4.114; amd. Ord. 97-O-2279, eff. 5-9-1997)

7-1-9: DIRECTION OF TRAFFIC RESTRICTED TO DESIGNATED OFFICIALS:

No person, unless authorized pursuant to this chapter, or otherwise authorized by state law shall direct or attempt to direct traffic by voice, hand, or other signal. (1962 Code § 3-6.302; amd. Ord. 97-O-2279, eff. 5-9-1997)

7-1-10: APPLICATION OF TRAFFIC REGULATIONS:

The operator of any vehicle, including any vehicle owned by or used in the service of the United States government, the state, and any county or city shall be subject to the traffic regulations of this title, unless specifically exempted by the state Vehicle Code or other governing law. 7-1-11: APPLICATION OF PARKING, STANDING, AND STOPPING REGULATIONS:

All vehicles shall be subject to the standing, stopping, and parking provisions of chapter 3 of this title, with the following exceptions:

   A.   City police or fire vehicles.

   B.   Private ambulance responding to an emergency situation.

   C.   City vehicles and public utility vehicles when necessary for use in construction, repair, or maintenance functions.

   D.   Any vehicle owned or operated by the United States postal service while in use for the collection, transportation, or delivery of United States mail. (1962 Code § 3-6.307; amd. Ord. 97-O-2279, eff. 5-9-1997)
