For the purpose of this Chapter, the following terms, phrases, words and their derivations shall have the meanings given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural include the singular and words in the singular include the plural. The word "shall" is always mandatory, not merely directory.
(a) "Director" means the Director of Public Service or his authorized deputy, agent or representative.
(b) "Excavation" means any opening in the surface of a public place made in any manner whatsoever for purposes other than sidewalk or apron replacement or utility pole location or relocation.
(c) "Facility" means pipe, pipe-line, tube, main, service, trap, vent, vault, manhole, meter, gauge, regulation, valve, conduit, wire, tower, pole, pole-line, anchor, cable, junction box, transformer or any other material, structure or object of any kind or character, whether mentioned herein or not, which is or may be lawfully constructed, left, placed or maintained in, upon, along, across, over or under any public street.
(d) "Person" means any person, firm, partnership, association, corporation, company or organization of any kind.
(e) "Public place" means any public street, way, place, alley, sidewalk, grass plot, park, square, plaza or any other similar public property owned or controlled by the City and dedicated to public use.
(f) "Substructure" means any pipe, conduit, duct, tunnel, manhole, vault, buried cable or wire or any other similar structure located below the surface of any public place.
(g) "Utility" means a private company and/or corporation or a municipal department engaged in providing a particular service to the general public.

(a) No person shall dig up, break, excavate, tunnel, undermine or in any manner break up any public place or make or cause to be made any excavation in or under the surface of any public place for any purpose or place, deposit or leave upon any public place any earth or other excavated material obstructing or tending to interfere with the free use of the public place, unless such person shall first have obtained an excavation permit therefor from the Director as herein provided.
(b) No permits will be issued for openings in excess of ten square yards in area, except for emergency openings or openings required by law, during the period from November 15 to April 1.
