ADOPTING ORDINANCE No. 6983-97
PROVIDING FOR THE ADOPTION OF NEW MATTER IN THE CODIFIED ORDINANCES OF THE CITY OF BEDFORD, TO APPROVE, ADOPT AND ENACT THE “CODIFIED ORDINANCES OF BEDFORD, OHIO 1997" (HEREINAFTER CODIFIED ORDINANCES), TO REPEAL CERTAIN ORDINANCES IN CONFLICT THEREWITH OR DEEMED OBSOLETE, AND TO DECLARE AN EMERGENCY.
WHEREAS, this Council has authorized a recompilation, revision and recodification of ordinances of the City of a general and permanent nature; and
WHEREAS, various ordinances of a general and permanent nature have been passed by Council since the last updating and revision of the Codified Ordinances in 1993; and
WHEREAS, such recompilation, revision and recodification has now been completed to the satisfaction of this Council;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bedford, Ohio:
Section 1. That the editing, arrangement and numbering or renumbering of the enacted ordinances designated in the Comparative Section Table of the Codified Ordinances are hereby approved as parts of the various component Parts and Chapters of the Codified Ordinances, so as to conform to the classification and numbering system thereof.
Section 2. All provisions of the Codified Ordinances shall be in full force and effect on and after 12:01 a.m., February 19, 1998.
Section 3. All ordinances and parts of ordinances in conflict with the Codified Ordinances are hereby repealed on and after February 19, 1998.
Section 4. The repeal provided for in the preceding section of this ordinance shall not affect:
(a) Any offense or act committed or done, or any penalty or forfeiture incurred, or any contract or right established or accruing before November 1, 1997.
(b) Any ordinance or resolution promising or guaranteeing the payment of money by or to the City, or authorizing the issuance of any bonds of the City, or any evidence of the City’s indebtedness, or any contract or obligation assumed by the City;
(c) The administrative ordinances or resolutions of the City not in conflict or inconsistent with the provisions of these Codes;
(d) Any right, license, privilege, or franchise conferred by any ordinance or resolution of Council on any person or corporation;
(e) Any ordinance establishing, naming, relocating or vacating any street or public way;
(f) Any ordinance levying or imposing taxes, assessments or charges;
(g) Any ordinance establishing or changing the boundaries of the City, or establishing ward boundaries for the City;
(h) Any prosecution, suit or other proceeding pending, or any judgment rendered prior to February 19, 1998.
Section 5. That the copy of the Codified Ordinances attached to the original copy of this ordinance and deemed a part hereof shall be kept by the Clerk of Council and in connection therewith or attached thereto in written form, the Clerk of Council shall maintain for reference all subsequent ordinances of this Council amending or supplementing this Code bearing such code, title, chapter or section designations.
Section 6. The ordinances and material included in the Codified Ordinances have all heretofore been duly published as required by law.
Section 7. This ordinance is hereby declared to be an emergency measure for the immediate preservation of the public peace, health and safety of the City of Bedford and for the effective daily operation of the various offices and departments of the City, and it shall take effect immediately upon its passage.
