  § 1078.01 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   GUEST. Any bona fide guest of a resident.
   IMMEDIATE FAMILY. Any spouse residing in a nonresident employee’s household and any dependent children.
   NONRESIDENT EMPLOYEE. A full-time, part-time, seasonal employee of any department, division, board, commission or officer of the city who does not permanently reside within the geographical boundaries of the city.
   PARKS AND RECREATION COMMISSION. The body established as such by authority of Council.
   RECREATION DIRECTOR. That person or his or her duly designated assistant who has been so designated by the Mayor and Council.
   RESIDENT. Any natural person who has a bona fide domicile in the city.
   SWIMMING POOL FACILITIES. That portion of the city owned property adjacent to the westerly line of city property known as Mannino Field (formerly named Bleser Field) and further described in a warranty deed from the Prime Realty Corporation to the city, dated March 12, 1962, and filed for record in the County Deed Records Volume 818, Page 36, such facilities consisting of, among other things, the main pool, bath house, wading pool, lawns, parking area, roadways and walks.

§ 1078.02 RULES AND REGULATIONS.
   (a)   The use of the swimming pool facilities shall be subject to such rules and regulations as may from time to time be promulgated by the Recreation Department not inconsistent with this chapter, and which shall be filed by it with the Mayor and made available for public inspection. A copy of such rules and regulations shall also be posted by the Department upon a bulletin board or other conspicuous place as it may select at the swimming pool facilities.
   (b)   Such rules and regulations shall be enforced by the Recreation Director, or, upon authorization of the Mayor, by any other person he or she may authorize.

§ 1078.03 TIMES OF OPERATION.
   The swimming pool facilities shall be open on such days and during such hours as are determined by the Recreation Director, and no person not specifically authorized by him or her shall enter upon or use the facilities except upon such days and within such hours.

§ 1078.04 ADMISSIONS; FEES.
   (a)   The use of the swimming pool facilities shall, because of limited accommodations, be limited to residents of the city and their guests, and nonresident employees of the city as provided in this section.
   (b)   Residents may use the swimming pool facilities only upon the purchase of season admission tickets or single daily admission tickets from the Recreation Department. Nonresident employees of the city and their immediate families may use the swimming pool facilities without being accompanied by a resident by purchasing daily admission tickets. The fees for such tickets shall be as set forth in Chapter 208 of the Administration Code - the General Fee Schedule.
   (c)   No season admission tickets will be sold to guests of residents, but any such guests, when accompanying residents to the facilities, may be admitted upon the purchase of and payment for single daily admission tickets at the prevailing fee for the day.
   (d)   The Recreation Director may, from time to time, increase or decrease any of the fees or charges established by Council with the approval of the Mayor and Council.
   (e)   Lost season admission tickets may be reissued by the Recreation Department upon satisfactory proof of such loss and upon the payment of a fee as set forth in Chapter 208.

§ 1078.05 AUTHORITY TO CLOSE FACILITIES.
   The Mayor, Safety Director or the Recreation Director, or in his or her absence, the chief life guard or anyone authorized by the Director, may close the swimming pool facilities whenever, in his or her judgment, such action is deemed necessary or desirable for the protection of the health, safety or welfare of the residents or guests entitled to use the swimming pool facilities, or for the protection of the health, safety or welfare of the people of the city at large. Such action shall in no way entitle the holders of any admission tickets to any refund therefor.

§ 1078.06 SUSPENSION OF PRIVILEGES.
   The Mayor, the Recreation Director, any member of the Police Department, the chief life guard or any other person authorized by the Mayor, shall have the power and authority to prohibit any action or conduct which he or she considers dangerous, improper or immoral or in violation of any rule or regulation promulgated by the Recreation Department or in contravention of this chapter. He or she shall have the power to suspend the privileges otherwise granted to the holder of any admission ticket.
