(a) Except when overtaking and passing on the right is permitted, the driver of an overtaken vehicle shall give way to the right in favor of the overtaking vehicle on suitable and audible signal being given by the driver of the overtaking vehicle. The driver of the overtaken vehicle shall not increase the speed of his vehicle until completely passed by the overtaking vehicle.
(b) Violation of this section shall be an infraction and shall be punishable as provided in N.C. Gen. Stat. § 14-4.
