§ 4-11.05 ISSUANCE OF PERMIT; STANDARDS.
   The Chief of Police shall issue a parade or motorcade permit when the applicant has agreed in writing to comply with all the conditions attached to such permit imposed by the Chief of Police through the requirements of § 4-11.06 of this chapter, unless the Chief of Police makes any of the following findings in writing with information explaining the finding directly thereafter:
   (A)   The time, route, or size of the parade or motorcade will substantially disrupt to an unreasonable extent the orderly movement of other traffic.
   (B)   The parade or motorcade is of a size or nature that would require the diversion of so great a number of police officers of the city to properly police the line of movement and the areas contiguous thereto that allowing the parade or motorcade would deny reasonable police protection to the city.
   (C)   Such parade or motorcade will interfere with another parade or motorcade for which a permit has already been issued. For the purposes of this section, parade or motorcade applications which may conflict with one another shall be either granted or denied in the time order in which they were received.
   (D)   The information contained in the application, or supplemental information requested from the applicant, is found to be false or incomplete in any material detail.

§ 4-11.06 ISSUANCE OF PERMIT; CONDITIONS.
   (A)   The Chief of Police may condition the issuance of any parade or motorcade permit so that such a procession does not unreasonably endanger the public safety nor the safety of the participants.
   (B)   Each parade or motorcade permit issued shall specify, and the applicant shall agree and comply with, the following conditions:
      (1)   The assembly area and time of assembly;
      (2)   The starting time;
      (3)   The minimum and maximum speeds;
      (4)   The route to be traveled;
      (5)   What part of the street, sidewalk, or alley may be used;
      (6)   The maximum number of units within the parade or motorcade and the spacing of such units;
      (7)   The disbanding area and estimated time for disbanding;
      (8)   The number of persons required to monitor the parade or motorcade and the number of reserve police officers needed, if any;
      (9)   The number and type of vehicles to be used, if any;
      (10)    That the materials used in the construction of any floats or other units shall be of fire retardant materials and shall be subject to such requirements concerning fire safety as may be determined by local fire safety personnel;
      (11)    That any sound amplification equipment used shall be operated such that amplification is at a fixed level and not variable;
      (12)    That the parade or motorcade shall continue to move at a fixed rate of speed and that any wilful delay or wilful stopping of such parade or motorcade, except when reasonably required for the safe and orderly conduct of the parade or motorcade, shall constitute a violation of this code and the permit; and
      (13)    Such other requirements that are reasonably necessary to protect the public from safety and fire dangers.

§ 4-11.07 NOTIFICATION TO PARTICIPANTS.
   After a permit has been issued, the applicant shall advise all participants in the parade or motorcade by written notice of the terms and conditions of the permit prior to the commencement of such parade or motorcade.

§ 4-11.08 NOTIFICATION TO OFFICIALS.
   The following officials shall be notified by the Chief of Police immediately upon the granting of a parade or motorcade permit:
   (A)   The Mayor;
   (B)   The City Manager;
   (C)   The local fire district; and
   (D)   The Public Works Superintendent.

§ 4-11.09 REVOCATION OF PERMIT.
   Any permit for a parade or motorcade may be summarily revoked by the Chief of Police at any time where, by reason of disaster, public calamity, riot, or other similar emergency, the safety of the public or property requires such revocation. The Chief of Police may also revoke such permit for any material failure to comply with the conditions attached to such permit. Notice of revocation shall be delivered in writing to the permittee by personal service or by certified mail delivered to the address specified on the application.

§ 4-11.10 PERMIT FEES.
   The Council, from time to time, may establish by resolution appropriate fees and charges for processing parade and motorcade permits along with appropriate fees and charges for police reserve officers, if necessary, and other city personnel or materials which are required to assist in ensuring safety for the public and parade or motorcade participants before, during, and after the procession.

§ 4-11.11 STREET CLOSURES.
   (A)   Closures authorized. The City Engineer may authorize the temporary closing of any street or portion of street for celebrations, parades, local special events and other similar purposes when, in his or her opinion, the closing is necessary for the safety and protection of persons who are to use that portion of the street during the temporary closing.
   (B)   Event sponsors. Sponsors of celebrations, parades, local special events and other similar purposes may authorize selected vendors and concessionaires to operate within the area of the street closure for the convenience of the visiting public. Event sponsors are authorized to charge a fee to such vendors and concessionaires so as to assist in the recovery of costs for sponsoring the event, including costs of liability insurance, utilities, security, barricades and other costs, and for fund-raising. Event sponsors may limit the type of vendors and concessionaires so as to prevent an undue saturation of any one type of goods or services being vended or displayed.
   (C)   Business licenses. Event sponsors may be authorized by the Finance Director to collect business license fees from all vendors and concessionaires and to issue event badges, certificates or other evidence of having paid the business license fee. All business license fees shall be promptly paid by the event sponsor to the Finance Director on behalf of the city. All authorized vendors and concessionaires shall prominently display the badge, certificate, or other evidence of having paid the business license fee while participating in the special event.
   (D)   Unauthorized vending. No person shall sell, vend or otherwise offer for sale any goods, food or beverage, or advertise services, on the street or parking lots at any special event in the area of the street closure without having paid the business license fee and the vendor or concessionaire fee charged by the event sponsor and without displaying the badge, certificate or other evidence of having paid same.
