   919.05 MINIMUM AND MAXIMUM CASH SURPLUS; RATE ADJUSTMENT.
   (a)   For the peace, health and welfare of the City, a minimum cash surplus in the Electric Department shall not be less than three hundred fifty thousand dollars ($350,000).
   (b)   Upon the City Treasurer’s report that the balanced account in the Electric Revenue Account is three hundred fifty thousand dollars ($350,000) or less, the electric rates in the City shall be increased by the percentage, not to exceed five percent (5%) of the current rate, to be determined by the Service Director. The increase shall be in effect within ninety days following the Treasurer’s report. Any further rate adjustment shall be determined by Council upon the recommendation of the Service Director.
   (c)   The electric rate schedule shall be as set forth in Section 919.02.

   919.06 EXTERIOR WIRING.
   (a)   All corporations, copartnerships, associations or individuals or agents thereof, operating in the City, must install and maintain and all their exterior and service wires in any street or alley in the manner required by the regulations of the Public Utility Commission of the State of Ohio or any orders or regulations now or hereafter existing, made by any duly authorized authority pursuant to the provisions of the Public Utility Commission of the State of Ohio.
 
   (b)   All poles and wires which are not in use and are not maintained in accordance with the safety and provisions of this chapter shall, upon written notice by the City, be repaired or removed by the corporation, copartnership, association or individual who owns, operates, controls, manages or has charge of such wires and poles.
 
   (c)   All City signal or light wires removed for any cause shall be replaced by parties removing the same to the satisfaction of the City and at no expense to the City.
 
   (d)   The Superintendent of Utilities shall have the power to require all exterior and services wires to be placed and maintained as provided for in this chapter, and on written notice from the Superintendent of Utilities to any corporation, partnership, association or individual, or agent thereof, calling for the correction or removal of any wires or poles or electrical apparatus of any kind, maintained contrary to the provisions of this chapter, the same shall be immediately removed or corrected by such corporation, copartnership, association or individual, or agent thereof, controlling, managing or owning such wires, poles or apparatus. The City is also hereby authorized and empowered to cause the turning off of the electric current from all conductors or apparatus which are deemed by the City to be unsafe or which have not been installed in conformity with the provisions of this chapter.

   919.07 CURRENT SHUT OFF DURING FIRE.
   The Fire Chief, or some other competent person delegated by them, shall have the power to, at once, cause the removal of all wires or the turning off of all electrical currents or both where the circuit interferes with the work of the Fire Department during the progress of a fire.

   919.08 MAIN ELECTRICAL DISCONNECT REQUIRED WITH ACCESS.
   (a)   From and after the effective date of this section, all electrical services installed within the City shall have one main means of disconnecting the electrical current delivered to such service. The Utilities Department of the City, or the utility company furnishing electricity to such service, if other than the Utilities Department of the City, shall have access to such disconnect at all times.
 
   (b)   From and after the effective date of this section, any electrical service requiring or permitting "potential metering transformers" or "current metering transformers" shall have an individual, weather proof disconnect switch located on the outside of the building to which such electrical service is connected. The Utilities Department of the City, or the electric company providing electricity to such service, if other than the Utilities Department of the City, shall have access to such disconnect switch at all times and shall have the right to disconnect electrical service to insure safety or in the event of nonpayment by the using customer.
 
   (c)   All electrical services installed on buildings constructed after the effective date of this section shall have electrical disconnects as provided in subsections (a) and (b) hereof, installed at the time of construction. All existing buildings requiring electrical disconnects as provided in subsections (a) and (b) hereof shall have such disconnects installed if the existing service is changed or updated.
      (1)   All electrical services rated at 400 amps, 3 phase, and 400 amps, single phase, and lower shall have an outside disconnect. This shall also include residential dwellings used as a commercial business, detached buildings from same, and agricultural buildings.
      (2)   Exempt shall be single family residential, 1-2-3 family residential, and any service rated above 400 amps, unless otherwise specified by the National Electric Code. This subsection (c) cannot be waived for any reason by any other governing body except as stated in subsection (d) hereof.
 
   (d)   The Utilities Department or Building Department of the City may waive the disconnect requirement at its own discretion or in case of hardship, safety reasons, or if due to inaccessibility on building areas, such as alleyways, fences, or any other obstruction. This can only be accomplished by written consent by both parties (customer and Utility or Building Department) involved.
