§ 1-9-19 ACQUISITION OF OLD ALBUQUERQUE HIGH SCHOOL.
   (A)   The policy of the city shall be to acquire the Old Albuquerque High School facility. The city shall negotiate for the purchase of Old Albuquerque High School and is authorized to exercise the city's power of eminent domain if necessary. The property shall be acquired by the city to improve and maintain the structures, to protect them, and to cause them to be rehabilitated to a beneficial reuse.
   (B)   The Real Property Division of the Finance and Management Department, the Albuquerque Development Services Division of the Family and Community Services Department, the Legal Department, and other offices of the city are charged with obtaining the materials and services necessary to proceed with a possible eminent domain action in order for the city to acquire the Old Albuquerque High School property. Furthermore, the Legal Department is directed to file a condemnation action in a court of appropriate jurisdiction if negotiations are unsuccessful.
   (C)   The amount of $1,500,000 is appropriated from the Metropolitan Redevelopment Fund (Fund 275) to the Albuquerque Development Services Program (Program 31003) of the Family and Community Services Department for the purpose of acquiring Old Albuquerque High School and for costs ancillary to this purpose.
   (D)   The Department of City Council Services shall be included in all steps of this activity.
   (E)   If the city purchases Old Albuquerque High School property through negotiations and the purchase price exceeds the amount of $1,500,000 appropriated in division (C), further approval by the City Council is required. Once the city acquires the Old Albuquerque High School property, any reuse plan, change in ownership or use of the property shall require further approval by the City Council.
