§ 4-6-10 MUSIC OF NEW MEXICO PROJECT.
   (A)   The Albuquerque Museum shall establish a new project to preserve the folk music cultures of Albuquerque and New Mexico by causing the music of traditional artists to be recorded and distributed locally, nationally and internationally. This project shall involve establishing a new recording label entitled “The Albuquerque Museum - Music of New Mexico/Museo de Albuquerque - Musica de Nuevo Mexico,” should a legal search indicate that this name is available.
   (B)   This project shall record the traditional music of New Mexico's cultures, especially that which might be lost otherwise. All traditional New Mexico music shall be encompassed by this project. The project shall not be limited to any specific culture or cultures. This project shall not involve itself with commercially viable music at-he time it is recorded or produced by the project. The financial goal of the Music of New Mexico project is to recover costs rather than to generate profits. The project shall consider for release previously recorded music. Artists shall be compensated by a fair and equitable flat fee and/or royalties as appropriate. Songwriters shall be compensated pursuant to mechanical license fees when applicable. Fees shall be scheduled for payment according to modern standards of practice in the recording industry.
   (C)   An advisory committee shall be formed to help guide the Albuquerque Museum with the Music of New Mexico project. The advisory committee shall consist of scholars, performers, promoters and other individuals knowledgeable about the traditional music of Albuquerque and New Mexico. One of the committee's members shall be the owner of a commercial recording studio. The project manager shall consider the following individuals, among others, as initial members of this committee: Enrique La Madrid University of New Mexico; James Leger, Highlands University; Brenda Romero, University of Colorado; Cipriano Vigil, Northern New Mexico Community College; Jack Loeffler Manuel Rettinger; and Jeanie McLerie. At the time an individual serves as a member of the advisory committee, he or she shall not have any recording or producing contracts with the Music of New Mexico project.
   (D)   The advisory committee shall assist the Albuquerque Museum in the following tasks:
      (1)   Establishing written criteria for the selection of artists and music including insuring that project not be involved with commercially viable music as specified in this legislation;
      (2)   Developing written standards for the selection of recording studios which shall be done by a formal city contract process;
      (3)   Guiding the Albuquerque Museum in establishing the financial relationships with artists; and
      (4)   Engaging in such other tasks as may be needed to insure the success of the project.
   (E)   The Albuquerque Museum shall be responsible for the following with regard to this operation:
      (1)   Providing program staffing, operating and accounting support;
      (2)   Selecting artists and interpreting the music to be used in the preparation of liner notes;
      (3)   Being responsible for any copyright issues and other contractual matters;
      (4)   Assisting in the distribution of the recordings and the dissemination of the music especially for educational purposes; and
      (5)   Conducting such other tasks as are necessary for the successful operation of this project.
   (F)   The Albuquerque Museum shall not establish a recording studio, but shall utilize the services of commercial recording studios for this project.
   (G)   A “Music of New Mexico” Trust and Agency account shall be established within the Museum Program (Program 23004) of the Cultural and Recreational Services Department. This account shall be the repository of funds appropriated or granted to this project by government agencies and other sources and revenues earned by the sale of recordings and related materials.
   (H)   The amount of $25,000 is appropriated from the Unreserved Balance of the General Fund (Fund 110) to the “Music of New Mexico” Trust and Agency account for the purpose of supporting this project. It is the intent of the City Council that the same amount shall be appropriated to this account for five consecutive fiscal years, at which time it will be determined whether the project is self-supporting. Future appropriations shall be based upon this review.
   (I)   The Albuquerque Museum also shall seek funds from other government foundation, and private sources to expand its activities within the scope of this project.
