(A) The city shall not extend city infrastructure or allow grading to properties within water pressure Zone 2W and also within the proposed boundaries of the Petroglyph National Monument; however, improvements to the Unser Boulevard right of way may be undertaken if the alignment and improvements are approved by the Council.
(B) The city shall not issue building permits for properties within water pressure Zone 2W and also within the proposed boundaries of the Petroglyph National Monument.
(C) The city shall not grant approval of site development plans or approve final subdivision plats, except bulk land plats, which are within water pressure Zone 2W and also within the proposed boundaries for the Petroglyph National Monument.
(D) For the purposes of this section, the proposed boundaries of the Petroglyph National Monument include all properties designated by Congressional action as within the Monument and all additions to the Monument made administratively by the National Park Service pursuant to authority granted to it by Congress.
(E) Property owners who have received city approval for development plans and in addition either have utilities extended to their site or have secured all approvals for well and septic service may make application for building permits and approvals of specific development plans.
(1) Upon such application, the city shall notify the National Park Service if the property is designated for acquisition by the United States.
(2) If after a period of 12 months from the date of the application for building permits the United States or other agency has not acquired the property or initiated condemnation proceedings, the city shall issue a building permit to the property owner if the property owner has received all other approvals from the city which entitle the owner to a building permit.
(F) The plans for construction of Unser Boulevard from Ouray to St. Joseph's Ave. as it may be located in Water Pressure Zone 2-W and the Petroglyph National Monument, which are attached to Resolution No. 42-1991 as Exhibit A, are approved. This includes none of the Unser Boulevard paving but does include some related berming, wing-wall and outlet work.
(G) City policy on grading within the boundaries of the Petroglyph National Monument, is amended to also allow grading and related improvements within public easements adjacent to the Unser Boulevard right of way if the improvements are approved by the Council. The National Park Service should have some flexibility in directing construction of the noise berms to make them more naturalistic.
