(A) There is hereby established the Joint Advisory Commission on Persons with Disabilities, hereinafter referred to as the “Commission,” which shall be composed of 10 members to be appointed as follows:
(1) Four members shall be residents of Bernalillo County and shall be appointed by the Bernalillo County Commission.
(2) Six members shall be residents of the city and shall be appointed by the Mayor with the advice and consent of the Council.
(3) At least two of the members appointed by the Bernalillo County Commission and four of the members appointed by the Mayor shall be persons with a disability.
(B) The terms of the members of the Commission shall be for three years; provided, however, of the members first appointed, one member appointed by the Bernalillo County Commission and two members appointed by the Mayor shall have terms expiring on October 1, 1988, one member appointed by the Bernalillo County Commission and two members appointed by the Mayor shall have terms expiring October 1, 1989, and one member appointed by the Bernalillo County Commission, and two members appointed by the Mayor shall have terms expiring October 1, 1990. The Bernalillo County Commission shall determine which members appointed by it shall have which terms and the Mayor shall determine which members appointed by the Mayor shall have which terms. Any additional members added to the Joint Advisory Commission on Persons with Disabilities subsequent to the February 23, 1988 adoption date of this resolution shall have a term concurrent with that of the members whose terms expire October 1, 1993.
(C) Except as otherwise provided herein, the city members of the Commission shall be governed by the provisions of the Revised Ordinances of Albuquerque, New Mexico, which governs all boards, commissions and committees.
(D) The powers and duties of this Commission shall be as follows:
(1) The Commission shall study the problems and the programs for people with disabilities, including, but not limited to, those in the areas of housing, human rights, employment, recreation, and transportation.
(2) The Commission shall review and recommend program funding sources.
(3) The Commission shall advise the Mayor, Council, and the Bernalillo County Commission on programs to provide services to persons with disabilities, including but not limited to the areas outlined in division (D)(1) above. The Commission shall make recommendations regarding short and long range priorities in these areas, regarding a comprehensive program for persons with disabilities, and regarding coordination of programs funded by different sources.
(4) The Commission shall promote the understanding of the problems of and the programs for persons with disabilities among public officials, volunteer agencies, and residents of the city and county.
(5) The Commission shall comply with all applicable policies, ordinances, resolutions, and rules and regulations of the city and the county of Bernalillo.
(6) The Commission shall cooperate with other Boards, Commissions and Committees to further the cause of persons with disabilities.
(7) The Commission shall make written annual reports to the Bernalillo County Commission, Council and the Mayor.
(E) The organizational structure of the Commission shall be as follows:
(1) Officers.
(a) The minimum number of officers of the Commission shall be not less than two officers (such as the Chairperson and Vice-Chairperson) and such other officers as the Commission may deem necessary.
(b) All officers shall be elected by the members for a term of one year and no officer shall serve more than two consecutive terms.
(2) Meetings.
(a) All meetings of the Commission shall be open to the public and insofar as possible, shall be held at a facility owned either by the city or Bernalillo County.
(b) Reasonable notice shall be given to the public prior to any meeting of the Commission. At least once a year, the Commission shall determine what is reasonable notice to the public of its meetings; provided that in no event shall notice be less than the notice required for Council meetings.
(c) Minutes shall be kept of each meeting and filed with the City Clerk and copies of the minutes shall be sent to the Mayor and the Bernalillo County Commission.
(d) The Commission shall meet at least quarterly.
(e) A majority of all the members of the Commission shall constitute a quorum for the transaction of business. A motion shall carry upon the alternative vote of the majority of the members present at any meeting.
(3) Rules and regulations.
(a) The Commission may promulgate such rules and regulations for its conduct as may be deemed necessary.
(F) Upon request, the Bernalillo County Manager and the Mayor shall provide assistance for such staff and resources as is feasible and within existing budget limitations.
(G) An evaluation will be made every year as to the effectiveness and viability of the Commission. Recommendations will be made for possible changes in the membership makeup, agenda, format and/or purpose of the Commission.
