§ 2-1-11 CAPITAL IMPROVEMENTS ADVISORY COMMITTEE.
   (A)   A Capital Improvements Advisory Committee (Advisory Committee) is hereby established, in conformance with the New Mexico Development Fees Act.
   (B)   The Advisory Committee shall advise and assist the municipality and county in adopting land use assumptions, review the capital improvements plan and file written comments, monitor and evaluate implementation of the capital improvements plan, file annual reports with respect to the progress of the capital improvements plan and report to the municipality and county any perceived inequities in implementing the plan or imposing the impact fees, and advise the municipality and county of the need to update or revise the land use assumptions, capital improvements plan and impact fees.
   (C)   The Mayor and the Board of County Commissioners shall make available to the Advisory Committee any existing professional reports requested by the Advisory Committee that pertain to developing and implementing the capital improvements plan.
   (D)   No members of the Advisory Committee shall be employees or officials of a municipality or county or other governmental entity.
   (E)   Not less than 40% of the voting membership of the Advisory Committee shall be representative of the real estate, development or building industries. At least two of the voting members satisfying this requirement shall be appointed by the Board of County Commissioners.
   (F)   (1)   After the requirement of division (E) has been met, the remaining Advisory Committee membership shall be drawn from:
         (a)   Community representatives (such as neighborhood organizations); and
         (b)   Professionals dealing with land use matters (such as professional engineers, architects, landscape architects and land use planners);
      (2)   Of the people appointed by the Mayor under the provisions of this section:
         (a)   No more than one may receive the majority of his or her income through the provision of services to people In the real estate, development and building industries; and
         (b)   At least two shall be current or recent officers of neighborhood associations.
   (G)   The Advisory Committee initially shall be comprised of ten voting members. Of the ten voting members, six shall be appointed by the Mayor of the city, with the advice and consent of the City Council, and four shall be appointed by the Board of County Commissioners. The term of each member shall be three years unless the appointment is to fill a vacancy. The initial terms of the voting members shall be staggered so that at least one member from each of the three above-mentioned groups (i.e. developers, community representatives, professionals) is eligible for re-appointment or replacement each year.
   (H)   The Advisory Committee shall include six non-voting members, from whom a replacement to the voting membership of the Committee will be chosen in case of vacancy. Of the six non-voting members, three shall be appointed by the Mayor, with the advice and consent of the City Council, and three shall be appointed by the Board of County Commissioners.
   (I)   The Advisory Committee shall elect a chairperson and adopt rules and procedures in keeping with the ordinances governing public boards, commissions and committees.
