OFFICER AND EMPLOYEE FINANCIAL DISCLOSURE
TITLE: Officer and Employee Financial Disclosure

BACKGROUND
Effective operation of City government requires transparency from the City's leaders to earn the public's trust. Elected officials and city employees have various responsibilities to identify and disclose financial interests pursuant to Article XII, Section 5 of the City Charter and Section 3-3-5 of the City Ordinances. Accordingly, three tiers of disclosure requirements for city officials and employees have been established to ensure compliance with the City's Conflict of Interest rules.
POLICY
Tier 1- includes all elected officials, the Chief Administrative Officer, the Chief Operating Officer, the Chief Financial Officer, the Chief of Staff, the Deputy Chief of Staff, members of the Environmental Planning Commission, members of the Albuquerque Development Commission, members of the Landmarks Commission, the Planning Director, the Zoning Hearing Examiner, the Zoning Enforcement Official, the City Engineer, the Director of Municipal Development, the Capital Improvements Project Official, and the Administrative Hearing Officer.
Tier 2- includes all other Department Directors including the Director of Council Services and the Director of the Civilian Police Oversight Agency, all Department Deputy Directors or Deputy Chiefs of the Police or Fire Departments, the Inspector General, the Chief Procurement Officer, members of the Air Quality Board, members of the Accountability in Government Oversight Committee, members of the Arts Board, members of the Board of Ethics, members of the Fire Code Board of Appeals, members of the Housing and Neighborhood Economic Development Committee, members of the Information Services Committee, members of the Labor-Management Relations Board, members of the Lodgers' Tax Advisory Board, members of the Open Space Advisory Board, and members of the Urban Enhancement Trust Fund Citizens Committee.
Tier 3- includes all other city employees and board and commission members.
By July 31, 2021 and by January 31 of each calendar year thereafter all Tier 1 and Tier 2 employees and officials shall complete a financial disclosure form on a form designated by Clerk. Should a new conflict or potential conflict of interest arise, all Tier 1 and Tier 2 employees and officials shall submit a conflict of interest form within ten (10) days oflearning of the conflict or potential conflict. Tier 1 and Tier 2 Board and Commission members shall fill out a financial disclosure form following appointment and approval by City Council. Tier 1 and Tier 2 Board and Commission members shall submit a conflict of interest form within ten (10) days of learning of the conflict or potential conflict. Tier 1 individuals shall fill out all parts of the financial disclosure form. Tier 2 individuals shall fill out all parts other than the fourth section regarding real estate interests.
All Tier 3 Board and Commission members shall sign an acknowledgement of the City's Conflict of Interest Rules. All Tier 3 employees shall receive training on ethics and conflicts of interest during new employee orientation. In the event a conflict or potential conflict of interest arises, all Tier 3 officials and employees shall submit a conflict of interest form within ten (10) days of learning of the conflict or potential conflict. This form shall be a public record.
DISCIPLINE
City employees or officials who fail to promptly disclose potential conflicts of interest may face disciplinary action according to the Merit System Ordinance or other applicable ordinances, the City's Personnel Rules and Regulations, or Collective Bargaining Agreements if applicable. Board and commission members who fail to promptly disclose potential or actual conflicts may be subject to removal from their board or commission pursuant to ROA 1994, 2-6-1-1 et seq.
This Administrative Instruction is effective immediately.
