The City Council finds that:
(A) After verification that the Petition to create the Downtown Albuquerque Business Improvement District complied with Section 6 of the Business Improvement District Act, the Council passed resolution Bill No. F/S R-44, Enactment No. 38-2000 referring the petition for the creation of the Downtown Albuquerque Business Improvement District to the Downtown Planning Group for preparation of a district plan, authorizing the City Clerk to provide notice of public hearing on the plan, and directing the Downtown Planning Group to make a recommendation to the Council regarding the creation of the Business Improvement District as proposed, or as amended, after public hearing.
(B) The required public hearing on the proposed district plan has been completed.
(C) The Downtown Planning Group has forwarded to the Council its district plan (the "business improvement district plan"), a copy of which is attached to Ord. 38-2000 as Exhibit A, and its recommendation to create the district in accordance with the district plan.
