No permit shall be granted for the construction of such fence or wall unless the applicants have first executed, recorded and delivered an instrument in writing covenanting for the owners of the fronting property and their successors in interest that the fence or wall to be constructed under the authority of said permit shall be removed at the cost of the then owner of the premises on notice by the city and further covenanting for the owners and their successors in interest the indemnification of the city against any and all claims, lawsuits or litigation for damages or injuries arising out of the construction or maintenance of such fence or wall, such covenant to run with the land.
