(A) Appeal to the Planning Commission. Any person aggrieved with any determination of the city staff acting under this article may appeal to the Planning Commission by submitting written application to the Planning Department within 15 days after the date of the city's decision. The date the determination by the city is issued is not included in the 15-day period for filing an appeal, and if the 15th day falls on a Saturday, Sunday, or holiday as listed in Chapter 3, Article 1, Merit System; Personnel Policies, the next working day is considered as the deadline for filing the appeal. Such appeal shall be heard and decided by the Planning Commission within 60 days of its filing.
(B) Appeal to the City Council. Any person aggrieved with any determination of the Planning Commission acting under this article may file an appeal to the City Council by submitting written application to the Planning Department within 15 days of the Planning Commission's decision, such 15-day period to be determined as in division (A) above. The City Council may decline to hear the appeal if it finds that all needed city plans, policies, and ordinances have been properly followed. If it decides that all needed city plans, policies and ordinances have not been properly followed, it shall hear the appeal. Such appeal, if heard shall be heard within 60 days of its filing.
