(A) Multiple use is encouraged for drainage rights- of-way and drainage easements including, but not limited to, utility corridors, recreation trails, and parks. Where multiple use is planned by the city, another public agency, or a public utility, the city may require that dedication statements include language which permits said specified multiple uses in addition to the primary drainage function, flood control, stormwater or stormwater quality control, or erosion control. However, land required to be dedicated for drainage related rights-of-way shall be limited to those land areas necessary for drainage control, flood control, stormwater quality control, and erosion control and necessary appurtenances.
(B) Certain drainage rights-of-way may be credited for open space as may be required by the IDO, except for any area which is exclusively used for the drainage control, flood control, stormwater quality control, or erosion control function.
