(A) Prior to the adoption of a proposed rule that the Commission determines may have an adverse effect on small businesses, the city, either through the governing body for legislative rules or through the appropriate department for proposed administrative rules, shall provide a copy of the proposed rule to the Commission. The Commission then may notify associations or owners and officers of businesses which are likely to be affected by the proposed rule that they may submit data or position papers to the Commission or its designee as to whether the proposed rule will:
(1) Impose a direct and significant economic burden upon small businesses; or
(2) Directly restrict the formation, operation or expansion of a small business.
(B) Prior to the adoption of a proposed rule that might have an adverse effect on small businesses, the Commission shall prepare a small business impact statement that includes the following:
(1) An identification and estimate of the number of small businesses subject to the proposed rule;
(2) A brief description of the projected reporting, recordkeeping and other administrative costs required for compliance with the proposed rule, including costs associated with the type of professional skills necessary for preparation of the report or record;
(3) An analysis of the costs of compliance for small businesses required to comply with the proposed rule, including costs of equipment, supplies, labor and increased administration;
(4) A statement of the probable economic effect on small businesses, including lost sales and revenue;
(5) A description of any less intrusive or less costly alternative methods of achieving the purpose of the proposed rule or a reasonable justification for not employing the methods;
(C) Upon finalizing the small business impact statement, the Commission shall submit their report to the governing body or appropriate department.
(1) If an Economic Impact Analysis (EIA) has been requested for a particular proposed rule pursuant to F/S R-08-176, then the small business impact analysis shall be made available to the City Council at the same time as the requested EIA.
(2) If submitted prior to final action or adoption of the proposed rule, the report shall be made a part of the record of deliberations of the governing body or appropriate department, and the Chair of the Small Business Advisory Commission or his designee shall have the opportunity to present the findings of the report to the Council or appropriate department prior to final action or adoption of the proposed rule.
