(A) Whenever the Mayor believes that the operation of a methadone center, with or without a permit, is being or will be conducted within the city so as to create a public nuisance as that term is defined in Section 30-8-1 NMSA 1978, he may initiate judicial proceedings to abate continued operation of such methadone center.
(B) Whenever the Mayor believes that a methadone center is operating in the city without a permit, he may initiate judicial proceedings to restrain or enjoin such operation.
