(A) Uniform. No licensee or his employee shall wear any uniform or badge of a pattern or design that may be mistaken for or confused with the uniform or badge in use by the regular members of the Albuquerque Police Department, Bernalillo County Sheriff Department, or State of New Mexico Highway Patrol. All uniforms and badges to be utilized by a licensee who is licensed hereunder shall be exhibited to the Chief of Police and approval obtained in accordance with this division (A) prior to its being worn or utilized. A licensee shall not be required to change the design or pattern of his uniform or badge if any of the government agencies mentioned in this division (A) change the pattern or design of the uniform or badge now in use to a pattern or design similar to one used by a licensee.
(B) Vehicle Insignia. No licensee or his employee shall operate a vehicle with an insignia, decal, or other marking of a pattern or design that may be mistaken for or confused with a vehicle having an insignia, decal, or other marking in use by the regular members of the Albuquerque Police Department, Bernalillo County Sheriff Department, or State of New Mexico Highway Patrol. All insignias, decals or other markings to be utilized on a vehicle operated by a licensee or his employee shall be exhibited to the Chief of Police and approval obtained in accordance with this division (B) prior to its being utilized. A licensee shall not be required to change the pattern or design of a vehicle insignia, decal, or other marking if any of the government agencies mentioned in this division (B) change the pattern or design of the vehicle insignia, decal or other marking now in use to a pattern or design similar to one used by a licensee.
