§ 13-5-1-24 SPECIAL RULES APPLICABLE TO CABLE SYSTEMS: RATE REGULATION.
   (A)   The city may regulate any of a grantee's rates and charges to the extent it is permitted by law.
   (B)   With respect to any rate, the regulation of which is governed by FCC regulations, the city will follow the FCC rate regulations in its regulation of each grantee, notwithstanding any different or inconsistent provisions in the franchise.
      (1)   In connection with any such rate regulation, the city will ensure a reasonable opportunity for consideration of the views of interested parties.
      (2)   The Mayor is authorized to issue such regulations, and to take such actions as may be necessary or appropriate in order to enable the city to regulate rates in conformity with applicable law. Without limiting the foregoing, while any final rate order establishing rates or ordering refunds must be issued by the City Council, any other rate order may be issued by the Mayor.
   (C)   The City Council shall be responsible for issuing rate orders that establish rates or order refunds. A grantee must comply with all rate orders issued by the City Council or the Mayor pending appeals by the grantee unless a stay order has been issued by the FCC.
   (D)   Except to the extent the city may not enforce such a requirement, a grantee is prohibited from discriminating in its rates or charges or from granting undue preferences to any subscriber, potential subscriber, or group of subscribers or potential subscribers; provided, however, that a grantee may offer temporary, bona fide promotional discounts in order to attract or maintain subscribers, so long as such discounts are offered on a non-discriminatory basis; and a grantee may offer discounts for the elderly, the disabled, or the economically disadvantaged; and such other discounts as it is expressly entitled to provide under federal law, if such discounts are applied in a uniform and consistent manner.
   (E)   A grantee shall not deny access or charge different rates to any group of subscribers or potential subscribers because of the income of the residents of the local area in which such group resides.
