The Council finds it necessary to grant a franchise to the New Mexico Utilities Inc. ("NMUI") to develop, lay, re-lay, construct, maintain, operate and remove pipes, systems, works, lift stations, manholes, reservoirs, appliances, and other structures and facilities, on, under, along and across all public rights-of-way in the city for the purpose of distributing water and collecting wastewater for domestic, commercial, institutional and industrial uses, to be used or collected in NMUI's service area all as more specifically set out below.
