This ordinance [upon which §§ 13-4-3-1 et seq. are based] shall become effective 30 days after its adoption by City Council; provided the company, within the 30 days, shall have filed with the City Clerk an unconditional acceptance thereof, unless a petition is received in accordance with § 3-42-1 NMSA 1978, during which 30-day period this ordinance [upon which §§ 13-4-3-1 et seq. are based] shall be published in the manner provided by law. Within ten days after the filing of the acceptance, the City Clerk shall acknowledge in writing the receipt of the acceptance. Should the company's occupation and use of city streets, alleys, public ways and public places remain continuous after February 15, 1992, the obligation to remit any fee to the city in accordance with § 13-4-3-5 shall not be abrogated or otherwise discharged should this ordinance [upon which §§ 13-4-3-1 et seq. are based] not be effective until sometime after February 15, 1992.
