(A) Before any permit authorized by this article may be issued by the Mayor, the applicant for the permit shall:
(1) Submit to the Mayor a written application for the permit in a form prescribed by the Mayor, and stating the information required; in the case of renewal applications, they shall be submitted at least 30 days prior to termination of existing permit; and
(2) Pay the Zoning Enforcement Officer of the city an initial application/permit fee of $275, which is not refundable in the event the permit is denied.
(B) (1) Before issuing a new permit the Mayor shall cause a notice of the application therefor, in a form prescribed by the Mayor to be posted conspicuously on the outside of the premises for which the permit is sought, which notice shall be posted over a continuous period of at least 20 days prior to approval or denial of the permit.
(2) It is unlawful for any person to remove or deface any notice posted in accordance with this section. Any person convicted of a violation of this division (B) shall be deemed guilty of a misdemeanor.
(C) If the Mayor affirmatively determines, upon inquiry and examination, that the policies of this article and the standards set forth in § 10-9-5 have been fulfilled, he shall grant the permit.
(D) If the Mayor determines, upon inquiry and examination, that any of the requirements have not been met, the Mayor shall notify the applicant in writing of his findings, including any specific deficiencies in the application. In addition, the Mayor shall:
(1) If applicable, give the applicant a specified time, but not less than the ten working days from the date notice is served or received by certified mail, to correct the stated deficiencies, at the end of which time the permit may be denied. If the requested corrections are not made within the period of time specified, the Mayor shall deny the permit.
(2) Notify the permit holder that he may appeal the decision by requesting a hearing as set forth in Section § 10-9-8 on the question of whether there are deficiencies in the application.
(E) A permit shall be effective for a period of 12 months from the date of issuance unless earlier revoked or suspended as provided by this article.
(F) Procedures and fees for permit renewals shall be the same as those specified herein for new applications, except that the fee for renewal applications shall be $100.
