The City Council may designate by resolution certain areas of the City as Security Assistance Funding (SAF) Districts, for which the provisions of this section shall apply. In making such a designation, the Council must find that the area meets the following conditions:
(A) The area is a commercial or arts and cultural district with significant economic development, art or cultural impact, tourist-related facilities and attractions or tourist-related transportation systems, or is of other significant importance to the city. The area cannot be primarily residential in nature.
(B) The area is compact and contiguous enough to be identifiable as a distinct area of the city, and must be listed with specificity by blocks and map.
(C) The City Council has received an application requesting the designation of a SAF District from ten or more business owners comprising at least 51% of the total business owners in the proposed district or from five or more real property owners comprising at least 51% of the total real property owners in the proposed district, exclusive of any real property owned by the United States or the state or any of its political subdivisions. Prior to submission to the city, the applicant shall work with city staff, including staff from APD, DMD, DFAS and Council Services, to jointly develop a proposed security plan for the area. The application shall:
(1) State the purpose for the creation of the district;
(2) Describe in general terms the real property to be included in the district;
(3) Include a security plan developed in conjunction with city staff, that addresses specific public safety issues within the area, including specific criminal offenses that are prevalent in the area. The security plan must be specific to the area and backed up with verifiable data.
(D) The designation as an SAF District is valid for one year and the Council must reconsider and readopt these findings on an annual basis in order for the area to maintain the SAF District designation.
