(A) Operators of Overnight Lodging Establishments shall maintain a guest register, reservation book or reservation card ("Register") and shall require every person who rents or occupies a room within the Overnight Lodging Establishment to write in such Register his or her name and place of residence. Such registration shall be made on a page of the Register properly dated with reference to the day of the year, month and week and the time of day the person rents or arranges to occupy a room. The Mayor may ask the Operator whether a particular person is a guest at the Overnight Lodging Establishment. The Operator must confirm or deny to the Mayor whether that person is a current guest. The Mayor must obtain a subpoena to examine the Register. Overnight Lodging Establishments may use portfolio cards or a computer generated format in lieu of the Register.
(B) The Owner or Operator of an Overnight Lodging Establishment shall maintain a record of all extended stay guests and of all guests participating in the motel voucher and lease program. If more than 10% of the Overnight Lodging Establishment's units are rented or leased for an extended stay, then the owner or operator shall notify Albuquerque Code Enforcement. If the Overnight Lodging Establishment participates in the motel voucher and lease program, it shall notify Albuquerque Code Enforcement of its participation. Albuquerque Code Enforcement is authorized to apply to District Court for the issuance of a subpoena to order the production of records and evidence demonstrating that the Overnight Establishment is housing extended stay guests or that it is participating in the motel voucher and lease program.
